Hello .. I was recently raided over the summer . they found 19 plants a half ounce , a scale , a bong, and 40 $ US. The are trying to get me on dealing \and growing . MY question is what am i looking at here ? Im getting a good lawyer and this is my first offense . can some one that has been in my situation before help me out and give me a idea of what im gana have to go threw ? My arraigment came in the mail the other day i have to go to court in 4 weeks . Im a little nervous ....

The state is Michigan . I looked at the norml website . but it doesnt give me a accurate idea at what im getting . i was hoping some one who has been to court for stuff like this would give me a answer , I talked to a guy that i know and he got busted with like 300+ plants and he only did a year w/ a court appointed lawyer . so im thinking \hoping i wont do jail time . i hope i dont . id rather just be on probation for a long long time . Everything is all messed up though , there is a lot of talk that is not being followed up on . like on the search warrant they had ..It didnt have my name on it. It had a friend of mines name on it.not me.They also lied i didnt have 19 i had 15 in one pot , about a foot tall each ,outside , They also "claim" they found a ounce in my room but that is a flat out lie , i never had no ounce . all i had was a half and it wasnt in my room , Also . i dont know if it even means anything but i was 17 at the time , and after i was realeased from jail the next day they gave me a piece of paper that said if i want my scale and money back that i would have to pay $400.00 to get it back , on that same piece of paper it had a wrong street adress to my house. I dont know if that even matters or not but i was just wondering .Im waiting to chat with my attorney and see what he says . . ..Advice please?

dude, I'm getting jail time for a second offense dui,and I got jail time on my first. I don't think NO jail time is going to happen with 19 plants. A simple possession bust maybe, but growing is a felony in most states. I don't think probation is what they'll be going after in case

Oh wait....you were 17 at the time? then theres hope. If you get charged as an adult though, well.....

Dude that definatly sucks, sorry to hear about that. I had a dui for my first offense when i was 19, never served any jail time and just lost my license for 6 months, lost my license for 6 because i refused a breathalizer. If i had a jury trial and lost they could have gave me some jail time to teach me a lesson, but i didn't have a trial. For my first offense with a dui i took a drug/alcohol class, after it was complete, all i had to do was stay out of trouble for a year and it would be erased from my record which it was. If i was to get a dui now it would count as my first offense and not my 2nd, but i also can't take the drug/alcohol class again. If you had a dui or dwi, basically samething, if you didn't take the program the first time and got that charge again, you can't take it then either. My lawyer told me the program is more like a get out of jail free card, if you weren't told about bein able to take a drug/alcohol program after your first dui, i see it as you bein f*cked over by the system, but a lawyer if you had one, should have let you know a progam like that does exist for first time offenders. Maybe your state is a little different than mine, but i would think that no matter what state your in, you should have been able to take such a program for a first offense. Even if you were caught with marijuana, first time offense you can take a drug/alcohol class, or should be able to, depends on the state, to avoid jail time for a first offense.

As for the person who claims they had the wrong information on the warrant, sounds like you might have a technicality there, definatly get a lawyer, and you probably won't serve any time or any probabation, it doesn't matter what they found, if a technicality is there, consider yourself lucky because you might get off on all charges.

No, I had a lawyer, and no such class exists in SD. After a first offense, there is a required "Drunk Driver" class you have to take, but thats in addition to all the fines, jail time etc, and it wipes nothing off your record. After a second offense, you must take an alcohol/psych evaluation, and complete any recommeded treatment before you can even get a work permit. (second offense is manadatory 1 year license suspension as well) Luckily, I'll have that completed before court, or shortly after, as I don't get offically sentenced until the 8th I mentioned jail time previously, but I already know I'll be serving 5 days, as everyone here recieves an identical sentence for 2nd offense, with very few exceptions.

That really sucks, 5 days in jail isn't that bad i guess. In my state when people go to jail for 2 duis, that is if they never took the program, they serve 30 days in jail for their 2nd offense and i think they lose their license for a year or it might be 3 years, can't really remember. I think in the other guys case though with the pot, he still might have a chance to get let go for everything if theres a technicality, those make a big difference.

So is there any one out there who has been raided like i did who never had to do jail time out there ? Is there any one out there that can help me .thanks for the replys .. but i think my charges are much more serious than a dui charge , they told me when i got poped that i could be doing 8 months in a prison.I think they were just tring to scare me . so i would snitch ..but their tacrtics didnt fase me . They black mailed me in sighning this thing saying that everything in the house was mine ,they said if i didnt sighn it that my mother would have to be charged with it since she is the home owner ...kinda ****ed me over on that ... they kept ignoring the fact that i wanted a lawyer present during my interigation , everytime i brought up getting a lawyer they would quickly change the subject and start talking more and more .they also refused to let me call a lawyer . And refused the lawyer talk to me latter on after the interigation was over . my lawyer called up at where i was and they refused to let him talk to me . im not a law expert but i swear i read some where that it is illeagl to do that . some one please give me some real advice . thanks .
