| Hey, new here, wahts up!?! Got a question for a paper im writing...Im wondering, is a paraphernalia charge considered a violation of a controlled substance law? Or does that law only concern the drug itself? Thanks, Mike |

| Not sure, here in texas paraphanalia (like a pipe) is a fine of $500. Other than that I don't know, but I don't think so Anyone else know anything more? Kind of curious myself.

| My guess is that the paraphernalia law is considered a "controlled substance law". After all, they're not supposed to be able to do anything about the pipe you just bought that is clean with no residue on it -- they are legal if you use them for legal purposes, like smoking your own tobacco. It is only when they have marijuana residue on them that they become illegal, and so I think it is logical to conclude that the paraphernalia law is also a controlled substance law.
