Default Controlled Substance Laws.

Hey, new here, wahts up!?!

Got a question for a paper im writing...Im wondering, is a paraphernalia charge considered a violation of a controlled substance law? Or does that law only concern the drug itself?

Thanks,
Mike

Not sure, here in texas paraphanalia (like a pipe) is a fine of $500. Other than that I don't know, but I don't think so Anyone else know anything more? Kind of curious myself.

Perhaps you could help us help you with a little more depth. Are you asking if the paraphernalia law is codified in the same section as controlled substances? It could vary from state to state. Details, man, details are required before we do your homework for you - and a small fee to the site, click the link and donate relative to the grade you wish to receive.

My guess is that the paraphernalia law is considered a "controlled substance law". After all, they're not supposed to be able to do anything about the pipe you just bought that is clean with no residue on it -- they are legal if you use them for legal purposes, like smoking your own tobacco. It is only when they have marijuana residue on them that they become illegal, and so I think it is logical to conclude that the paraphernalia law is also a controlled substance law.

Paraphernalia laws name specific types of apparatus as being illegal, used or not, residue or not. Look it up.
