My child is a college student living in a dorm, someone turned her, sayting that drugs were being used in her dorm room. the cops went straight to her room and found seeds and stems in her trash can. That was all that was there, no papers, no pipes, no actual Marijuana. The cop ask her what it was and she told him it looks like stems and seeds, he of course ask her how she knew this and she told him it was becuase she had seen it before.

She is now being considered to be kicked out of dorm and school and suspended over stems and seeds.

I say stems and seeds are not proof of drug use, as they are stems and seeds and there is no other evidence of drug use......she is a straight a student on a full scholership....

she volunteered to take a drug test, she has paid for it and failed it.....she said she was at a party 10 days ago where there was smoking going on, but did not participate, I say it is illrelevant wheather she passed or not, or smoked or not, stems and seeds are not proof....

In the real world can you get arrested for stems and seeds? Any help would be greatly apprecieated, don't want to have to get a lawyer.

From the DEA website, keep in mind federal laws trump state laws.

(16) The term "marihuana" means all parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds or resin.

My ex husband was kicked outta the air force for 3 seeds and a burnt incense stick. The govt is out there.

In most of the US, it's not against the law to smoke marijuana. It's against the law to possess it. As previously noted, all parts of the cannabis plant are legally marijuana. The only exception is sterilized seeds.


She's probably lying. It is almost impossible to fail a THC test by inhaling only second-hand smoke. Exhaled smoke contains almost no THC. Side-stream smoke contains THC, but you'd have to sit in a small closet, door closed, with four other people who were smoking for an hour to absorb enough THC to fail a test.

If she scored positive on a test ten days after "exposure" she is more than a one-time smoker.

Sounds to me Maryc like you're definitely not a MJ user....or you'd know you've been had by your daughter. It's college....college equals partying...partying equals booze and drugs. However be glad it's just a lil MJ...there's worse stuff out there that she could be doing. She toked to fail that test....you don't just get dirty from being in a room like that... mind you Buzzby doesn't mean a dorm room the size of a closet...he means a real closet....with a towel stuck under the door so no smoke got out. I could NEVER pull the wool over my 'rents eyes...but they were also hippies...daddy used to distribute...and they both still smoke! If they're talking about kickin her out of school...don't wait...get a lawyer. I have no clue how my aunt did it but my cousin got caught with a fat sack of MJ at school...and they threatened to expel him. I think they just had the fear of god put in em...but i really don't know. I don't normally suggest lawyers, since i think 99% of em are swine. But it sounds like you need legal advice.

How long will THC stay in your system after you smoke? I mean how long will you test positive after you smoke? she said she tested within a range of 0 to 20 but did not give me any more information.

if you smoke just one time, on a clean system, it should be out within 3-7 days. the more frequently you smoke, the longer it will stay in the system, up to a month or more even.

Elsewhere on this site are the exact specifics for which you asked, but reality is that she is a regular smoker and anything you are looking for is an effort to let/get her off the hook. Dad, your daughter smokes pot and anything you are dealing with right now is a coverup. Numbers mean nothing, you cannot find the legal justification to let her off the hook. She be token!

Seeds and stems were enough. Time for Plan B. She might look into a local community college and negotiate a semester/quarter off to regain her options. She knew the potential before the pot party in her dorm room, you should not try to cover for her silly behavior. Others have already testified that she is smoking and the University Police have much more evidence than they have let on.

The system responds better to realistic matters than legal arguments, throw a bunch of money at this problem and find out how the legal system works. Cupcake might need a reality check; she is not using her intellegence to prevent any bad judgement from becoming problematic. Proper legal representation might clean this matter up better than you imagined. A good reality-check for your Cupcake would not hurt.

all that i know is that in canada it isnt illegal to posses seeds, u can buy seeds, sell seeds, and it isnt illegal intill u start growing them, but i do know that seeds and stems found in a garbage can is enough to get a warrant to search the place, but then again if its in the dorm and theyve already searched the trash can then they dont need no stinkin warrant

Umm... Actually, it is illegal to buy and sell seeds in Canada, it's just tolerated. If you get caught, you get a fine. Just like the Netherlands (Amsterdam, for example).

The reason they don't need a warrant in the dorm is because the dorm is the school's property. A trash can is rarely covered or they'd need a warrant to look inside (so long as the can isn't the school's property, too). She really should have gotten rid of the trash right after the party -- so there'd be nothing left in her room for them to find.
