| Situation: A student at a high school was caught with a small amount of marijuana after smoking it in the parking lot. After intense questioning, he admitted to buying it from a student who is known to deal by the schools administration, but has never been caught or punished. The administration knows more just by word of mouth. The student that was caught told the teachers that he bought the marijuana a few days before. In addition to the student who sold the weed, the kid also told the administration of a second guy who assisted the main dealer. Both these kids were called down, a police officer dispatched to the school, and then everything was searched. After searching the cars, lockers, bags, and pockets of the kids, their siblings, and even closest friends, not a single bud, rolling paper, bag, or pipe was found. The administration decided the kid caught with the marijuana would be given a 5 day suspension, and drug counseling. And the two kids who sold it to him 10 day suspensions. Even though everyone knows these two kids sold the weed, there was never any actual proof besides the one who was caught with the weeds testimony. That is the only thing they have, and they used it to justify a huge suspension, well over possession of alcohol or marijuana on campus, and nearing the level of bringing an unloaded gun or a knife to school (15 days suspension). Is there anything that can be done? This doesnt seem legal at all. There is nothing in the student handbook that would justify, and the administration hasnt used it to justify it. Although these kids didnt do very well in school before, missing 10 days has pushed them to nearly failing, meaning many hours of summer school etc. Any help would be appreciated, thanks! |

| Reactions like this just underscores the fact that people are very afraid of marijuana. I would fight this like hell. Make the administration pay for their decision. Also, organize!!! Start discussions with other students about legalization. Tell people about NORML, the Denver vote and the campaign to legalize in Nevada. Put marijuana into a different context than the "stoned looser". The thing that will piss the administration off the most is to remind them exactly how powerless they are to stop their students from getting high. Make sure that they know the trend is going against them. Drugs are in every single high school in America. I know there were plenty in mine. |

Marijuana's popularity is probably greatest in high school and college and steadily decreases as people get older. Also, if enough kids impress on their teachers and administrators that marijuana use is inevitable then it may force them to deal with it using something other than a zero-tolerance policy. I'll remind you: there is nothing wrong or immoral with using marijuana, even if the user is under 18 or 21. Though, I wouldn't recommend it for people under 14.

| The administration obviously oversteped their boundries, the guy should sue the kid and school for slander, if there is no proof its one person's word against another's. |

| Unfortunately if the kid(s) are underage there is little they can do. The school is acting as the parent and can administer discipline as they see fit. If the kid had been arrested and charged with something, this would be another matter entirely. |

| School, much like a career, is another word for prison, you have the least amount of rights you will ever have at school, unless of course your country becomes a dranconian state(an inevitability almost)

I'm glad that there are at least some young people who take school seriously and do their best to get something out of it. I get the feeling that people who b*tch about school are the ones making little effort and who are achieving very little in return. Certainly the ones who are getting high in the parking lot are not taking advantage of whatever opportunities are available. Modern life is full of systems into which we need to learn how to fit. School is a good preparation for that. These systems are our "jungle" and we need to learn to navigate successfully through them.

Legalization still seems like a pipe dream at this point anyway. While in the mean time lots of underage people will be gettin' high. Sure, I support 21+ laws that at least legalize pot for somebody (like medical marijuana laws) but I know that the truth is that high school kids like pot!
