I'm 18 and in Michigan what would happen (not exactly the law but most likely) if I were caught smoking but didn't have any weed on me. I never own any I just smoke with friends. Sometimes at my house sometimes at theirs. I don't really know what they can do legally if I don't posess any? But am under the infulance and cooperated. What would be the most likely thing the police would do? Note jailes are over packed here I'm on probation for a non drug related issues.

Well that is sort of a toughie...but is one of the conditions of your probation to not use "illicit drugs"??? I believe if you're caught high but don't have anything on you it's either public intox/DUI...depending on if you're behind the wheel when they catch you.

well sometimes the cops let u off on pvs I hear friends droping dirty 12 times in a row b4 a po dose somthing about it. My po let on of my buds slide 12 times b4 giving him community service. I don't think if yer indoors u can have a public intoxication. I just wondered the bastard friends I have would just pin all the weed on me. I know 2 of them wouldn't but 2 of them would. Yea I just hate being paranoid when I'm high I don't know how my only neghibor feels about it. I talk to her in the hallways but I really don't know her. hmm oh well. thx it dose give me an idea of what could happen.

Look here cuz, u need to take care of your business. You can't be having people put **** on you. First thats not a friend. and second u need to take care of that. Get in their face and let them know u won't take that ****. Friends got your back, they don't try to give it to the cops.

Are you serious? California? Well, crap. Good to know; I live here and had no clue. Although one time me and my buddy were blazed as hell in my dorm elevator. There were about 5 of em headed to the 10th floor because some girl had alcohol poisoning (Ironic huh?). We had to have reeked and we each had mad munchies in our hands. My buddy had a big ass sandwich and the cop just looked over and said "wow that looks tasty". My buddy just smiled and replied "Oh it's delicious officer". Haha, ya those were some tight cops.

In the US it's generally not illegal to be high unless you're driving or making an ass of yourself in public.


With friends like that, who needs enemies? The most likely thing is that they'd arrest all of you for possession.

I hate to disagree, Buzzby, but I know that at least here in SD, its a crime to "be under the influence of an intoxicant other than alcohol" and the charge is a Class 1 Misdemenaor, carrying the same potential for punishment as possession of less than 2 ozs of actual marijuana (often charged together, if weed is found). SD also has an "internal possession" law, where, if a controlled substance is revealed by a urine test, you can be charged with possessing that drug. Weed is usually charged with the "other intoxicant" law whereas other drugs earn you a possession charge. its been challeneged, but has this far been help up the the SD supreme court. Our state's Constitution was even changed in order to allow this type of prosecution

Note that I said, "In the US it's generally not illegal to be high unless you're driving or making an ass of yourself in public." You have pointed out one of the exceptions. One that really sucks, in my opinion.

i live in MI and just happened to be at my friends house when the DTF raided. The sheriff that was the lead guy told me that they could charge me with possesion cause i was high at the time, but never did though. The sheriff was a guy i went to high school with so maybe thats why i didn't get charged. Or maybe to much paper work???
