Default jailtime?

Im new to these forums and I just had a question about the law. My boy got some charges against him and I wanted to know if theres any way he can avoid going to jail. The charges he got are possesion of marijuana with intent to distribute, possesion with intent to distribute within 1,000 yards of a school zone and possesion of a firearm with an obliterated serial number. He posted bail and doesn't go to court til February. Hes 22 and the only other time he been arrested was for a misdemeanor. We live in Boston. So do any of you know if theres any way he can get off wit probation? Or if not how much time you think hes looking at?

Looks like he hit the trifecta - pot, school, stolen gun. Was he dealing? Was he at the school? And what's up with having the gun, Dad?

Do you know the difference between jail and prison - because from my experience he will be lucky to go to jail and not prison. He faces some serious felonies - and serious time.

That sounds like some serious ****. I know that here in PA having any drug within 1,000 feet of a school = jail time. The Intent to distrbute and weapon charges just make it worse.

Unless he hires a VERY good lawyer, my guese would be hes screwed.

The law is pretty severe when it comes to being in possession of a weapon while committing a felony. The tricked out pistol indicates the intent to use it in a crime. Strike two. Near a school? Strike three.

Buy all the lawyer you can afford. Keeping the kid out of prison is going to take some powerful legal maneuvering. If it weren't for the gun it might have been feasible to cop a plea to a lesser charge. The gun makes it unlikely that the DA will want to bargain.

Nah he wasn't at a school his house is just right down the street from a high school and in MA selling drugs in a school zone is a seperate offense I guess.
The gun was his and the obliterated serial number is what people do when the gun is stolen the serial number on the gun is filed off so cops cant see where its was stolen from. It really aint my business why he had the gun. I know the difference between jail and state prison I just meant either of them.


He has a court appointed lawyer and he doesnt have no way to get a good one so from what you guys is saying it sounds like hes ****ed. Would it be likely he would go to a state prison or a house of corrections and does anyone have an approximate idea how much time he can get for each one of the charges?

It would be state prison. Houses of correction (at least in my state) are for misdemeanor offenders.

Plan on celebrating his 30th Birthday with him, maybe - and buy him some soap on a rope. Your son will likely get 8 to 10 years in a medium security facility, and a lot of privacy with his new boyfriend, err . . . cellmate. Court appointed defense is not going to do much for him.

And it is best not to play anyone for a fool; we all knew the gun was his and the obliterated serial number is what people do when the gun is stolen; that the serial number on the gun is filed off so cops cant see where its was stolen from.

The only way I can think of, and it seems to work for some of the worst scum on the earth, is to have enough people testify that your son is nuts..and has depression problem.... it seems to be the only thing to explain being that stupid.

Unhappy my opinion...

well from my experience, he is definatly looking at jailtime. my boy just got his house raided (cuz the cops were looking for stolen property, witch he didnt have...another story) and they found a blunt roach and a airsoft gun under his bed and he got a year probation with weekly drug tests and whatnot.

on the other hand, about 10 years ago my uncle and his 2 other partners got hit up wit mad plants and pounds of bud. the one snitched and got a big fat check (and coincidentaly he lives down the street) and my uncle and the other guy got moved around the country to 16 different prisons for 8 years.

im not supporting anyone to snitch, but thats the only thing i can find possible to lessen the charges. either that or find the best lawyer in your goddam state, but it looks like thats not an option.

no way, not unless it was a lot of marijuana and the judge is an ahole. how much did he get busted with?

in MA its a mandatory minimum of two years if you're growing or selling within 1000 feet of a school. if the gun was loaded, which it most likely was.. he'll get possibly another couple of years with less than a year for just the possesion because this is his first offense. i'd be willing to bet he'll get 3-5 years if he's white.
