I am going to inform the courts/judge when I go next week, that I am interested in a community service program to expunge a first offense misdeameanor conviction for possession of marijuana in California. What should I expect? Will he most likely grant my request? I'm just hoping he doesnt suspend my drivers license even though the ticket says I was a pedestrian. What does community service consist of anyway?

Capn Obvious says "serving the community".....but it differs from place to place. I have seen some people pick up trash...others that did time at soup kitchens...where ya from? Then maybe someone from that area might be able to help you out more specifically. Hope you don't have court on Monday though...seems like judges are pissier on Mondays...

my court date is dec 20th (tuesday) @ 8am. If I wait till the court date to tell them I would like community service or the diversion program will it already be too late? Should I ask the judge about community service or ask about the diversion program?

ASK A LAWYER. don't be stupid and wait. It may just be that the judge will give you the pre-trial diversion option at your court date. Since this is your first offense you will definitely get your conviction expunged. But ask a lawyer to make sure.
