This is my second time being issued a mj citation (less than 1 oz). My first one was waved because i told the judge i go to AA and NA meetings and see a counseler. I previously had a clean record. She told me she would not be leanient if she were to see me again. I just got another ticket only 1 month after my first one. I live in Ca and am 18. Is there any way i can get a harsher punishment because this is my second offense although the 1st offense was waived?

From my understanding, the normal penalty is a $100 fine plus court costs in Cali. I don't believe that this changes with subsequent arrests, menaing that the puinishment remains the same whether it was your first arrest or your tenth.

Because you're under 21 you'll probably lose your driver's license for a year.

I hope you're kidding. Thats a picture of the Dalai Lama. He is 70 years old. Its a shame how ignorant some people are and this leads to a lot of stereotypes about marijuana. A big reason that marijuana remains illegal is because people like you facilitate these stereotypes.

Anywho, I think that since there is ne legal records other that the court cases, they may consider this your fist offense anyways. Calafornia's legal systems is very laid back though, you might get off with another warning, unless you go up against the same judge.
