| Alright, i'm 16 and i'm in a drug treatment program for something really stupid that i'd rather not go into. Its a once a week thing, and they drug test me, naturally. i've been clean for about 6 months and now have decided to start smoking again. I told my parents and therapist this, since it'll come back on the screens anyway. They werent thatangry, but my parents keep saying that if screens dont come back negative enogh, the drug program can have me legally remanded to a dy-treatment program. Can they legally do this for only smoking 1-2 times a month maximum, and if they can even try to, can i fight it in court? | |

| who knows how far the arm of the law can extend itself? why put urself into so much trouble? why not just get passed this phase and when its over, smoke urself silly? granted, im not in ur position, but i think if i was, that would be my plan of action hope all goes well ![]()

| Yes they can. Yes you can fight it in court, but that takes money ---like your college fund, your siste's college fund, your home would need to be maxed out on a mortgage and your parent's take home salaries for the next year? well half would go to an attorney's firm. And you will still probably lose. But it would be a great test case and might even make it to your state Supreme Court before being remanded to the lower court for re-trial, if you were that lucky didn't get it dismissed out of hand. So the real question is...why is it worth it to you to smoke a couple of doobies? Discuss why with your parents and therapist. The reason why smoking a doobie is worth losing your life, your families financial future and your personal futer -- since you will have been branded by the media as a pothead, and will never be able to shake that -- is the problem you really need to solve in your life. And it is probably also the reason you did whatever "dumb" thing it was you did. BTW many of us on this board have tried doing a dumb thing at least once. ~ have a cookie ![]() Good luck & Hugz | |

| Your parents can legally do pretty much whatever they want with you as far as drug treatment and counseling goes. That is unless they emancipate you. Sounds like they wouldnt do that though. ![]() As my mother used to tell me: " You are the child! I am the parent! " Just dont toke it up. The world isnt going to come to an end, and there are many years to come to enjoy the forbidden fruit. | |

| There was no legal requirement that put me in here. My parents decided to send me here, and it was only like, an hour a week commitment, so i decided not to make big deal of it. There was no legal trouble to begin with. Does that make an difference? | |

| from my knowlege if you go to this treatment thing on your own free will (like... the courts havn;t ordered to you to to avoid prosecution of some sort) then they cant make u do anything man i am no law expert.. but u are supposidly trying to help urself by going there, and if u decide not to go,u are totally allowed to do that but.. u said ur 16 so maybe your parents signed for you to be forced to show up or something.. i dunno. anyways.. hope that helped i would prolly have to sum it up with they cant force u to do anything. -foild | |

| It doesnt matter whether you've broken the law or not. Your parents can commit you to any treatment program that they want to. Basically they are saying to you: 'Fine, go ahead and smoke, but we will commit you if you fail the test' The only way you can take that power away from them is if they allow you to declare yourself emancipated through a court proceeding, meaning you are no longer their responsibility. But it doesnt sound like they will go that route. Just dont smoke and you dont have to be committed. Go through the weekly program that you are already in, and once they let you out of that toke away. | |
