so if your over 18 (obviously) and a cop just finds a pipe (or bong or whatever) on you but it has marijuana residue in it can u get busted?

My state does not have any drug paraphernalia statute. So a pipe without any residue would not be a crime. A pipe with residue in it can get you charged with drug possession in my state. However, there are some district court judges around here that have decided that residue is not enough for possession, and that there needs to be a "consumable amount." Other judges say any amount of residue, if the forensic lab can find THC in it, is enough. At some point, it will end up in the state's Supreme Court I suspect.

This is only one state though. It can vary from state to state.

What about a pipe that looks like it is used for drugs that has noticeable residue in it, but the residue is from 100% legal smoking herbs?

What is the procedure? To always test the residue? Or is any residue in a pipe automatically considered a type of offense first, with verification later?

It does not matter what the pipe looks like or what it is used for. In my state (and again, I am ONLY talking about my state), pipes and other paraphernalia are not illegal by themselves. What is illegal is the minute quantity of illegal substances INSIDE the pipe. So if there is a legal substance inside, it would not be a crime here.

Yes, it always must be tested. If you go to trial on a drug offense in my state, in order to prove the offense, you must have a certificate from the state forensic lab stating what controlled drug it was, and the exact quantity (for pipe/residue cases, we are talking about 1/100ths of a gram).

For this reason, unless the guy is a real turd, I don't bother with pot pipes. I am not going to waste the lab's time analyzing a few little ashes in the bottom of a pipe. So it usually gets tossed in the woods...then again, if the guy is a complete goober, screw 'em.

In my state(PA) paraphanilia carries a charge much worse then actual marijuana.

at my college people are always sitting around outside smoking (tobacco probably) out of hookahs and such. i've never seen them get busted.
