| Allright, a few questions. I was arrested because the cop fount 7 grams of pot, a glass bowl, and alcohol in my car (graduation party, sucks HUH? ) But, I never got read my rights when he arrested me, and I NEVER got a paraphenalia ticket from him. Only a speeding ticket and 3 pieces of paper saying what I was charged with. (Criminal complaints) I'm getting a good laywer, how do you think this will all go down in court? Will the judge give me a ticket for the paraphenalia or was the cop supposed to? I'm in Illinois if that helps @ all. |

| no you if you didnt get read your rights then your wernt placed legally place under arrest, im sick of this everyone is getting busted for this idiotic law it bs, just because they dont smoke they make laws saying we cant, good luck man your going to need it |

WRONG....The Miranda warnings only have to read if the cop plans on using statements used after the arrest against the suspect. You CAN be, and many people ARE, placed under arrest without having their rights read to them. When the officer catches somebody redhanded, as in this case, theres no need for questions. The officer has proof of the crime, and already has enough evidence to obtain a conviction without ever questioning the suspect. Actually, the officer can question the suspect after an arrest, but the statements made by the suspect won't be allowed in court Don't hand out legal advice when you are clueless as to the actual legality of something. Poor legal advice can have serous real lifwe consequences for people. Statements like" if you weren't read your rights, you weren't legally placed under arrest" are simply false. Anyone with the slightest amount of knowledge about the legal system should know that is not true. | |
