| I'm new and I really only have a question...maybe for some peace of mind. I live in Michigan. My husband and I went to a graduation party and when he parked the car and I got out, I found a baggie with some pot in it and a pipe laying in the grass. I didn't want to take it in with me, nor did I want any kids getting it, so I threw it in the car. (Sorry, everyone, I'm a total squeaky clean prude with not so much as a speeding ticket on my non-existent record). Anyway, we went into the party. Jump to 5 a.m. Monday morning. My son woke me up and asked for gas money and to take my car (his car was dead) because he had to travel 100 miles for a court appearance on a drinking and driving charge. Later on that afternoon, he called to tell me that someone driving behind him and seen them pass a "joint" between he and his passenger. He said his friend didn't have any cigarettes and passed him a cigarette. A little while later the state police stopped him, told him that someone saw them passing a "joint" can he search the car. My son said no because it's not his car. The cop asked them when they last smoked marijuana and they said a week ago. They searched the car and found the stuff that I had put in there to dispose of but forgot. My son told them after they found it that it is not his car and it's not his stuff; that his brother and mom drive that car. The cop said "so if I call your mom and brother, one of them will say it's theirs?" My son said he didn't know what we would say. I wish they would have called because I would have told them what happened. They arrested my son and left the passenger to find his own way home. I am frantic and feel sick to my stomach that my son is in jail over something that I innocently did. I am not even sure where he is...what city or anything. I called the court in that county and they gave me his lawyer's name, so I told him that this is all a mistake and he's had no knowledge of it being in there before he left for the trip. All the lawyer said is that he has to wait for the report. All I need is perhaps some advice on what to do. Should I go to my local police and tell them what happened? It's difficult for me to travel as I have a 3 year old at home. I just don't know what to do. Can someone please tell me what I can do......I'd gladly be arrested if that's the law because he does not deserve this. I was trying to do that right thing when I even picked up that stuff to keep it from someone using it. I don't want my son to pay a price for that. If the law says that I shouldn't have touched it or whatever, that's fine. I'll take the penalty, but I need to know where to go to get this cleared up ASAP. His lawyer just wants a trial, but I don't have the means to bail him out so he'll be in there until then. I need to do something before that. Any ideas? | If he has a lawyer, you should wait until the lawyer receives discovery and follow his advice. And you probably realize this already, but it's not a very smart idea to take illegal items and put them in your vehicle. If you are really that concerned about other people finding them and using them, call the police and have them take it. Or throw it into the woods. |

| Under the circumstances, we felt it was the best thing to do. In hindsight, it obviously wasn't. I guess there's not much else I can do. Thank you for your advice. |

| With all due respect, Ma'am, this story just rings of bovine scat. From the "found it in the bushes" bit to the "he was passing a cigarette" part, I find the whole thing less than believable. I say this not to anger you, but to offer you an opinion of the circumstances you present. If I were on your son's jury, I would not believe this explaination you are presenting. And I smoke weed. This is not likely the son of your current husband, right? And his DUI charge is not the first time he has been in trouble, right? And your son does smoke weed, right? In addition to smoking ciggies since he was a minor, right? This is not a college-bound superstar, right? The truth has a certain ring to it, and basic logic is very opposed to what you present. We call this the Teenage Trifecta - young males in a vehicle with MJ are busted so routinely that it is like shooting fish in a barrel for LEO's. Maybe the best direction for your little bunchkin is to get him into some Drug Diversion program. He is up to his eyeballs in trouble without this charge, and might need some strong changes to his approach on life. All I can ask from you, as a parent, is to raise your child to be someone I can live next door to; is your love-child meeting that criteria?

| I've only been married once and am still married to the same man....my children's father. I know, it's rare. This son that I speak of is 19 and was signed up to go into the Marines. He went up to a college for what's called a Senior Walk and he got an Operating While Impaired, along with at least 50 other kids. The fact that 50 other kids got it doesn't excuse his behavior, but my point is that I don't think all of those kids are drugheads either. They gave him the bare minimum penalty, a fine and 5 days community service...and will release his probation once the community service is done so that he can go into the Marines. He passed the drug tests they gave him in jail when they arrested him. So, with that knowledge, you may or may not still think it's the teenage ick thing that you were talking about. I just have to hope that the truth bears out. And yeah...I'd be proud to have him as my neighbor. My love-child? If you're referring to my niece that we adopted when my sister and her husband were killed in a car crash......yeah...she's a love child. We love her as if she were our own from birth. |

| Bart, I agree with you that this sounds like bunk. It is sort of like she is running it past us to see if a jury will buy it. Even if the pot was found as you say, and inadvertantly left in the car; Who is to say the "kids" didn't find it and decide to help themselves. I'm thinking that it wasn't a joint that was seen being passed between the friends, but the pipe. First you say your son called you to tell you what happened (later that day), then you state that you do not even know Quote:

| The only reason I even came on this forum was because my friend suggested that I find out what I could do to expedite things under the circumstances by looking on the internet since all his lawyer basically told me was to hang on until he gets a report and that I shouldn't worry and that because he has no prior drug offenses and that he passed the drug screening that was done in the jail. I only talked with my son for about two minutes...his girlfriend's brother, who was the passenger, gave me all the other information that I posted. The reason i say that I don't know where he is is because it's a tri-county thing and I don't know that area very well. I know he's not in the city that the police stopped him in because they do not have a jail. Again, thank you for your responses. I know the truth and I just have to hope to find the right people who will do what needs to be done. |
