| I'm really sorry if I'm beating a dead horse, but I've been searching the forum for the last few hours and I haven't found a good answer to my question. If i'm a passenger in a car and my friends are smoking but I'm not can I get in trouble if we get pulled over??? Although I'm not high at the time, however, I wouldn't pass a drug test. Alternatively, lets say the car smells like pot, but no one was seen actively smoking (i.e. it could be the pot itself for example) would everyone get in trouble, only the person in possession, or does it depend on the cop himself??? What if the person in possession takes all responsibility in either case?? From what I've read, it seems the only way for a passenger to get out of a possession situation is to say that they had no knowledge that there was pot in the car, but if it the car smelled like pot then that defense probably wouldn't work. Any help would be much appreciated. Its hard to get this sort of information Thanks |

| One of the longest running television shows is "Cops", certainly you have seen it? Any given episode will have a similar circumstance you describe. You already know the answer, so why is this information so difficult to accept? We call it the Teenage Trifecta - Young Males in a car with MJ. It seems to prevail, based on the posts here, that the most innocent suffer the greatest consequence because they have no record - and now do. While your question is not specific, it points me to a greater issue in your life, including your choice of friends. Why exactly are you concerned about - because of what might happen? I'd bet you have a real life story to tell.

| Well from what I've read it seemed like people gave some mixed responses to similar questions. What if one person accepts all responsibility?? Does that not make a difference if its apperant that the other people in the car knew that there was pot in the car? Some people's posts said that the passengers were let off while other times they weren't. I'm trying to figure out what the circumstances have to be for a passenger to be let off, or is this to broad a question?? I can provide as many details for this hypothetical as you'd like. See I recently got in trouble for some stuff, and so I can't F*** up again. However, none of my friends are in my situation so they're not afraid to take risks like smoking in their car. I'm just trying to go to a concert with them, but I know they're going to want to carry and/or smoke buds on the way up and back and I was wondering if there was any way I could avoid being in trouble if something were to happen like us getting pulled over. |

| Pozo Saloon? Rat Dog, too? It is a huge risk to appear in front of the same judge twice. I feel your pain, and understand your circumstances, but can you not travel on your own? Amtrak offers excellent connections. The Hound is the worst, but better than getting busted. The last few miles can be a risk, but your train/bus ride is an excellent defense. |
