I'm currently on workman's comp for a shoulder injury. When I go back to work can my employer make me take another drug test. I already took one when i got injured. I'm just curious becuase this whole work comp thing and my injury has my employer kinda pissed. Can they legaly do that just to give me a hard time?

That would depend on your contract/collective bargaining agreement/company policies/etc. Not really an issue of criminal law.

I agree that criminal law has nothing to do with this issue. I just wanted to add if you are getting Workers' Compensation Insurance Benefits, the Insurance company (or State if State funded) can test at any time. This is out of the Union or the employer's hands. If you test positive, they can yank your benefits. At least that is how it is in my state.

The company that I work for will drug test if you are off, for any reason, more than 90 days. Most companies have a clause that they can have you submit to a drug test if there is reasonable cause. They probably wouldn't have a big problem trying to show reasonable cause. Kind of like the "right to manage" clause in most contracts.
