This is sort of long but worth it.

Ok so last night I had smoked a blunt and about an hour and a half later I go to my favorite spot to smoke with my friends again, a secluded spot in my friends subdivision, off in the woods on a rock looking out on a lake. We had parked in the parking lot (pool area)waiting on my last friend (there were 4 of us) and the neighbor pulled up. He is a dick and likes to complain about everything. Thinking nothing of it we quietly go down to the spot about 100 yards away from the cars.

About 15 min. later we are about to roll up a blunt and we see a flashlight. Naturally we want to be safe and hide the weed baggy in my friends shoe. (I would have thrown it in the lake.) We just act natural and talk about the stars and the fish, we could see the light for and hear people walking around for about 7 min. later the cops come by us and don't even hear or see us untill I said "hello?" and then they came down the trail and got about 20 feet away and said " hold up your hands, show us your hands"

Naturally I said yes sir and did what he asked. So its two cops, one male, and the other female. They come up to us and ask "WHO HAS THE POT"... we respond" What?" We don't know what your talking about we came here after work to chill and watch the stars (it's 10:00pm)They tell us the neighbors called about a noise complaint...WE HAD SNEAKED DOWN THERE AND THEY COULDNT HEAR US OR FIND US SO THAT'S BULLSHIT." They then badger us about "Where do you work!?" while shining the light in our eyes. We respond and next they ask if we live here. We tell them our friend does and he gives them his address. They badger us about it and ask the same question three times to which we give the same answer. The whole time we are complying politely and not to my knowledge there are some papers (an empty role just the package) in the bushes. They see them and say "well why are their papers there?" really rudley and to which my friend responds " I don't know there are other people that probably come here too, they are not ours we didn't even know they were there." So they tell us keep your hands up we are going to search you!" The male comes over and begins to search us while the female shines the light directly in our eyes. He searchs my 1st friend, mearly by frisking him, there was a walmart bag on the ground to which he made him hold up and show what was inside...nothing but a receipt for popcorn when he had the munchies was in it. Next was me, then to the next, this friend is wearing a hoody and cargo shorts with baggy pockets on the side. The cop frisks him and then LOOKS in his baggy pockets, which contain an empty blunt wrap wrapper...At this point he says " Your sleeve smells like marijuana my friend." (he smoked an hour and 30 min ago, we had rode with the windows down, sprayed febreeze on eachother 3 times each, and he had been walking outside for a good 30min, and used eye drops.) So the female cop yells aggressively " search his hoodie jacket pockets!!!" and the cop does only to find NOTHING. so my friend says" I don't know why that is." The cop says " Cause you have been smoking." He says" No sir." so he decides to frisk my last friend, who looks sort of like a pot head lol... he has the weed in his shoe. He not only frisks him but grabs his groin to search there...like really grabs it. They find nothing and this is what they said..."We had a noize disturbance call and you boys shouldn't be out here, it's 10:00pm and people have to work the next day!" We say yes sir and maam and they tell us to leave. We leave only to drive about 5 houses down to my friends house. and light a blunt on the porch and smoke it there. We stayed for about 20 min. and never saw the cops leave the area...I guess they were searching around where we were to see if we had ditched it hahah. There is one sign in the parking lot saying you need to live there to use the basketball court, nothing about anything else, and no limit on what time you can be out there. Was any of this illegal? Can we still go there and not worry?

Please understand that there is something we call the Teenage Trifecta - Young males with MJ in public places are always going to get busted. Try it again and you will be regretting it. Nothing attracks attention more than the group of young men in a place they don't belong. And should you return to that particular spot, you are just plain stupid.

As for your efforts to disguise the smell - you admit by your extrodinary efforts that MJ smells, long after the smoker thinks it is gone. Learn about olfactory fatigue.

The police did nothing wrong, and properly did their job with officer safety and the interests of the property owner in mind. When the neighbor called, the officers had much more information than you think and the trifecta was in play. I'll bet the neighbor observed you smoking, and told the dispatcher and arriving officers. Afterwards, the officers returned to the neighbor's house to explain the situation and to follow-up. I can promise you that the neighbor was instructed to call again if you and the boys return - and he will.

Seems to me you ought to be thankful you got away with it this time and tone down the cocky attitude - review this website and you will find hundreds of stories that didn't turn out so well for the young men. Loss of your School Loans, your Driver's License, your big Career Plans and your dignity with your Family is a certain possiblility. You can avoid it all by keeping it on the down low and remembering weed is ILLEGAL.

...to answer your question; no, your rights were not violated. Don't give the cops a hard time for doing thier job, that's what your tax dollars pay for, mine too actually and even though I'm a toker, I like to know the cops are there when I need them. Just do like Mr. simpson suggested and keep it on the "down low"!

Ok not to be argumentative I know we attracted attention just because there were five teenagers together and old people hate that but I know for a fact that the neighbor had not seen us smoke it, because he never smoked it down there that night Or he could not have seen us anyother time for that matter because we would have seen or heard him come up to spy on us just like we heard the cops since it's a good like 500 yards from any house and no one can see you from the road or any house. It's also not that public although I do realize it is in the public technically but we should have the right to be down there if someone lives there, there are no indications or rules stating that we could'nt be down there after dark. I like to go down there and not even smoke and actually watch the stars and I will continue going down there. I appreciate your concern and advice and I didn't mean to come off with the cocky attitude I was just over joyed it turned out well instead of horrible like you stated, since I have buddies that has happend too. I know I have also been ignorant about the laws even though I know its illegal(hopefully legal soon) thank you for pointing me to the right place to learn more Im glad I read it, I believe in my luck though its kept me good for two years(that;s a different story) straight and I have been the same thing in the same spot and this was the first incident.

He didn't sound like he had a cocky attitude to me. I remember reading "Yes sir ... yes maam ... they consented to search ... they explained they were watching the stars ... the cops search failed" but I don't remember anything cocky.
