slate - im gonna go out on a limb and assume that afro is underage. if im right, does your reply about the confiscation of his/her unresinated lighter still stand? in other words, could a cop take his/her lighter given the fact he/she is underage (if he/she is.)

also, someone mentioned the fact that you dont smoke. i was just curious as to why you would dedicate yourself to so many questions when youre a cop for one, and two you dont toke up (anymore.) if thats too personal you dont have to answer...im just curious.

now for my question. if a cop has reason to suspect you might be growing dope in your house, no probable cause or testimonials, just a feeling they may have -- then, say, he were to come to my house and i refuse to let him in...could he then get a warrant solely on his 'gut feeling'?

In regard to the minor with a lighter I would take it per 308 PC tobacco paraphernalia(California Penal code sec).

Could I get a search warrant from a judge on a gut feeling? NOPE, not in CA.

As for why I started posting here and answer questions. First of all, I have never laughed so hard in my life.... I mean some of the things you guys post when you are ripped is classic.

Second and most important is education. Education is power. People in general don't understand why LEO's do the things we do. I'm just trying to shed some light on the subject in order to make life (yours and mine) a little easier.

Need some clarification for my hypothetical situation. (Jesse Jacksonism there.. heh.)

Okay, back to the previously mentioned situation.

So suppose I've smoked some marijuana, and all paraphenalia/evidence is stashed away, nothing incriminating is within plain sight anywhere in the apartment. A neighbor somehow catches a whiff despite of the incense (or perhaps is just super jumpy and calls the police over that). Now the police show up and knock on my door. I have two choices here.

1.) Don't answer the door. In this case, what would the officers responding to the call most likely do?

2.) Answer the door. In this case I would most likely have "redeye" and (from what I've been reading) smell like marijuana, despite the fact I figure I don't. Now in this situation, what are the officers entitled to do?

Search me? No big deal, nothing on me of course.

Enter the apartment? No big deal again, nothing incriminating would be left out. However the bedroom would smell like incense and I suppose marijuana slightly, although I can never smell it through the incense.

Now suppose the police do/say they smell marijuana in the bedroom, what then?

Basically I want to know at what point are they allowed to actually search through my belongings/locked drawers/etc..? Is a warrant required for that or does it fall under that grey area where it's up to the officer on the scene?

One, when you smoke and you get red eye. Buy VISINE. It works wonders, even on the reddest of eyes.

Second, Buy a odor eliminator, I have one called "Natures Own" it works wonder on the smell too, so use that and incense and NO SMELL at all.

Then keep a safe or some lockable container and put your bongs, marijuana, bowls, papers, etc etc, in there and your set for the cops. You won't have to worry about a thing at all.

I'll have to try the Visine deal. I wear contacts which are supposed to be taken out and cleaned nightly, but I only change them every 3 months or so. I could probably use it anyway, heh.

I used to keep Febreeze around, but I went through the stuff like crazy. (On the paranoia scale I rank at about a 9.2, I can never spray enough.)

And yeah, were I to have anything illegal on my property I would keep it in a locked container of some sort. That's basically why I'm asking about this. I'm curious as to when the police have the right to go opening and searching through my property. Is redeye/faint odor enough, or is more evidence required? I'd like to assume they'd need some solid evidence (such as a bong or weed lying around in plain sight), but should the situation ever arise I don't want to be caught off guard when they dive into the "grey area" of the law that I didn't know about.

The short answer is; No they can not come into your house just because they smell weed, but that grey area you are talking about is huuuuuuuuge.

There are over 50,000 state and federal laws in our Country. In Ca. 11553 H&S exempts MJ as a scheduled substance in regard to being under the influence. So now I have 49,999 other laws to chose from. See where that is going.

My suggestion to you is, avoid that scenario as much as possible.

thanks for clearing all that up slate. i can imagine the funny things you read here. you seem like a cop i could really respect. not like the a**hole i was referring to in my little hypothetical situation there.

on the lighter thing, what you said makes sense. im not really worried about it. i smoke in public constantly. i look of age so ive never been questioned.

Hey Stevie, I always look is the groin area for dope, money and guns. Dope/MJ is predominately kept in the groin area. Now, unless it's rock/wafer cocaine or heroin, then it's in the mouth.
