| I have looked all over the net, and even contact an attorney. I have been unable to come up with a good response. My question is, I currently have a bench warrant out, non felony, just a failure to show up in court. My question is, I recieved a job offer, but it is subject to a criminal background check as always. So I am wondering if anybody has past experience with this, and if it will show up. The response I have gotten so far is it will be about a 50-50 chance. any help will be greatly appreciated, thanks fellow cheaptalkers. |

| When I run a criminal history, it automatically checks for warrants. So it would come up. However, private employers use a different system for checking criminal histories. The system they use may or may not check NCIC for warrants. You have absolutely nothing to gain by continuing to avoid this charge in court. You are going to be caught eventually, and you will probably end up getting caught at the most inconvenient time possible. If it is after court hours, you will probably end up being held in jail until court opens. And a judge is going to have no reason to be lenient when it comes to bail, because you had to be brought in by the police. On the other hand, you could turn yourself into the court during business hours, and it would look much better for you. Bring cash to post bail with, and you will probably be released with a new court date. Then you don't have to worry about the warrant, or if an employer is going to find it. |

| I just want to back up Phuzz's point with a quick story. A relative of mine got himself in to the situation you are in. He then was taken in at the most inconvenient of times and spent, if I remember right, 6 days in jail. Maybe 5 and maybe 7 and definitely more than anyone wants to spend in there. One of those days was his birthday. His bail was absolutely ridiculous due to him not appearing in court. Not ridiculous as in out of line considering he no showed and never came back but ridiculous in what it was if you hear what I'm saying. Try to straighten your shit out on your own terms before you are made to do so on theirs.

| We use a national database search for a "national criminal history", then we contact the State where you last spent a significant amount of time (found by doing a social security number address trace), then we contact the city court system or local police department to see if you have any citations and/or arrests for minor offenses. After all that, then we will check the State Sexual Predator Listing, and the National Sexual Predator Listing. I can find out when you were arrested, what for, How you were released (O.R. or bail), when your court date was, what the outcome was, and what the sentence was. Then, we do a driving license history, to see if you have any citations or violations against your drivers license (Excessive speeding, Hit & run, Exhibition driving, DUI, etc...) Pretty thorough, but that is what the employer is paying for. There isn't much that can get through. Remember, all of your criminal history after you turn 18 is public record. I don't need your permission to investigate. I do have you sign authorization forms though. If you don't sign, I don't do the background check and you don't get the job. |
