| Here's the deal. Im on probation. For a battery charge. My probation was 6 months early term after three. First two months were perfect until me and my friend decide to go to a car show. Me and him only go. And throughout the whole car show my friend didnt pull out no mj or any joint or anything associated with mj. So on the ride home him and I are tired so I park in my neighborhood and me and him fall asleep. He wakes up and leaves my car and goes home. 5 minutes later a cop comes and says he's gotten a disturbance call which I didnt know nothing about. So he searches me and finds absoulutely nothing but my id. No lighter no nothing. Searches my car and finds a burnt joint which weighed 0.2 grams in my ashtray. He handcuffs me and I tell him that it isnt mine and it was my friends who had just left my car and didnt tell me nothing about it. (Which the cop put in the police report) So he flashes the light in my eyes and could tell that I didnt smoke that mj so he gives me a nta and lets me go. The next day my friend comes to my house and tells me he forgot to tell me that he left a joint in my car. So I bring him to the police station and my probation officer for him to tell the story. They both said they wish they could change it but cant it is up to the court. So I get my lawyer to make a notarized affadavid stating that I had no idea/nothing to do with the mj joint in my car and my friend taking full responsibility for it. He signed it and it got notarized and my lawyer gave a copy to my p.o officer and the da. Now my question is will the citation get reversed to my friend. My p.o. didnt violate because of the story. Plus I work and go to school and dont smoke mj and have never (juvinile or adult) obtained a mj charge. Will I end up ok. Many people say yes just would like an opinion. Sorry for it being so long thanks in advance. |

| See but im on probation so I cant get another charge. I was wondering if my friend signed the affadavid(my bad for the spelling) and its notarized can my lawyer take it to the da and just get the charge reversed to my friend. I know there isnt jail time involed for a 0.2 grams of mj but Im tryin to mak sure if I could reverse the charge onto my friend. My friend told the cop, probation officer, and my lawyer he wants to take the charge because it was his fault and he doesnt want me to get in trouble for something I didnt do so I was wondering if getting a charge reversed due to being wrongfully accused is possible. |
