| You know, I never can seem to get the right scoop concerning what the Federal laws in the US are concerning posession, use and transportation of marijuana. When and why would the Feds get involved concerning marijuana? Thanks! Daniel

| Most often you'll get the feds involved when your importing drugs into the country or crossing state lines. Federal laws a very similar to state laws, and you can be charged on both the state and federal if your found to have broken both, but its rare. The federal drug equivalency punishment table for distributing, importing, exporting or trafficking harvested marijuana is as follows: Weight (KG) ---------------- Prison (MO) ----------------- Fine ($) less than .25 ------------------- 0-6 ------------------- 500-5,000 .25-.999 ------------------------ 0-6 ----------------- 1000-10,000 1 - 2.4 --------------------------- 6-12 ---------------- 2000-20,000 2.5-4.9 ------------------------- 10-16 --------------- 3000-30,000 5-9.9 --------------------------- 15-21 --------------- 4000-40,000 10-19 -------------------------- 21-27 --------------- 5000-50,000 20-39 -------------------------- 27-33 --------------- 6000-60,000 40-59 -------------------------- 33-41 ---------------- 7500-75,000 60-79 -------------------------- 41-51 ---------------- 7500-75,000 80-99 -------------------------- 51-63 ---------------- 10,000-100,000 100-399 ----------------------- 63-78 --------------- 12,500-125,000 400-699 ----------------------- 78-97---------------- 12,500-125,000 700-999 ----------------------- 97-121--------------- 15,000-150,000 1000-2,999 ----------------- 121-151 -------------- 17,500-175,000 3000-9,999 ----------------- 151-188 -------------- 17,500-175,000 10,000-29,999 ------------- 188-235 -------------- 20,000-200,000 30,000-99,999 ------------- 235-293 -------------- 25,000-250,000 100,000-299,999 ---------- 292-365 -------------- 25,000-250,000 300,000 or more ---------- 30 yrs-life ------------- 25,000-250,000 Simple possession <without intent to distribute> will land a first time offender a sentace of zero to one year in prison and a mandatory fine of $1000 , and there is no mandatory minimum for a first time conviction. Hope that about answers your question. You really should pick up the book Marijuana Law by Richard Glen Boire, its a very informative book.

| Thanks! Appreciate what you showed me... less than .25 ------------------- 0-6 ------------------- 500-5,000 Simple possession <without intent to distribute> will land a first time offender a sentace of zero to one year in prison and a mandatory fine of $1000 I know that I am looking into this too deep, but if simple possession had a mandatory fine of $1K, shouldn't the punishment above say 1000-5000? I'd really like to see some statistics on how often people get convicted (federally) for marijuana. You don't hear about it much. |
