| Ok, so, I smoke in my room every night. I always sit by the window on my bed, and I leave the lights on and the window open. I usually close the blinds partway, but if I were to leave them open, and you know how well you can see into a lit-up room at night, and a cop was making his nightly rounds, and looked in and saw me hitting a bong or some other obviously made for marijuana paraphernalia, could he come knock on my door and arrest me or anything? |

| Because you referred to it as "your room" and you list your occupation as student, I'm guessing you're in your parents house........... They will be the key. He might have reasonable suspicion, but I wouldn't call it probable cause. Nothing prevents him from simply knocking on the door, talking to your folks and asking for their consent (maybe a little B.S.ing along with it if they hesitate). Only you know how your parents will respond. Just close the blinds dude.

| Word son, I had a cop come peekin at me through my blinds last summer while me and a few boys was havin a bowl or few... I was high, picked up a pellet gun, and started bustin pellets at him. Damn..not a good idea. Didnt get in trouble, but they did follow me for a few weeks. |

No law against that or we would all have a permanent crick in our necks from "NOT LOOKING" What a police officer canot by law do, is order you to not shut your blinds. This sounds too simple, I am certain. It is a building block. If we could be ordered to not conceal anything. Privacy would be gone. as would freedom. You have to look at building a case against anyone. First question. How did we come to the conclusion that this citizen comitted a crime? If a police officer smashes in your window, rips your blinds down, and then sees your smoking. It is not good evidence. Unelss you gave that police officer good reason to do those things. *Fire, cries for help, b.b's hittinghim in the neck...jeezus.. *Add up that a majority of user busts are coincidental. Which means we did something unwise. The chances of getting busted are actually slim. *Note: My problem is of course, there should be NO chance of arrest because it should not be a criminal act***opinion** Second question, which rests on the first. Can you prove it? This is where the D.A. and the police begin to liaise. "What happened, is the proof good, HOW was the proof obtained" Should all of those look good and reasonable, a District Attorney will most likely follow his or her duty and prosecute. Unless the courts are full and they have decided that other crimes need to be addressed. Which means, they want to prosecute it, but are not going to make it past the "Speedy Trial " limitation, or cannot count on a jury in that venue, or just do nothave the money. It is basically, once the applicable laws have been considered and used the District Attorney's call. And each is of course, a private person with private opinions. Which can lead to a jail sentence.
