I live in a "Drug Free Zone" because it's right next to a school. Is that federal penalty (doubled), only for sale if I was going to distribute to others, or is it for posession as well. I would NEVER sell weed to anyone, but I do occasionlly carry a small amount, usually 1/8 of an oz.

According to the NORML website for my state,

"The penalty for distribution of marijuana is up to 20 years in prison and a fine up to $25,000. The penalty increases for sale to minors and sale within 1,000 feet of a school, college or playground, or within 100 feet of a youth center, public swimming pool or video arcade to the next higher classification of offense"

So I take it the "Drug Free Zone" penalty is for sale only, and not for posession under 1 oz., right?

I always thought it was for possession as well... but that would be cool if it wasn't.. not that i'd smoke weed in a drug free zone anyways..

I have no problems with "Drug Free" zones near where young children may be exposed. Small children shouldn't be influenced like that... one of the few laws I actually agree with about pot.... it shouldn't be exposed to people who do not want to be. I smoke in the privacy of my/my friends' homes, so I've nothing to worry about unless I get caught carrying my pipe/weed to and from their houses.

Why are you guys always worried about federal penalties. The DEA could give a damn about a guy with an 1/8th oz of pot unless they think you can give them someone much bigger.

Your concern should be with state charges..........those are the ones you are far more likely to face.

I wouldn't be smoking in a drug-free zone.. I would merely be possessing less than an oz. of the green. Usually when I smoke I go outside the "drug free" jurisdiction, for peace of mind.

Thanks for the clarification. I guess I'm a little ignorant when it comes to how law/drug enforcement works. I just want to make sure I'm relatively safe. You're right, most of the time I carry 1/8 or a 1/4 ounce MAX.

He was, and my thoughts on that is that the federal penalties don't apply to him in that zone because its not under federal juristiction. I called it opinion because nobody else here will accept it as fact. Now lets see if i'm right about getting crap from people who don't understand, and make me wonder if it was a good idea to contridict myself. Peace-
