| Yesterday my friends and I stopped in a parking-lot at night to smoke (i know dumb idea anyway), we hadnt smoked in about 3 hours. A state trooper (from new york, home of sh1ttiest drug laws) pulls over and asks everyone to step out of the car. No one had even started smoking yet, the bowl wasnt even packed. He then searched everyone and found weed on my friend. It wasnt much, less than 2 grams if that. After he took it he charged my friend with possession and for driving under the influence. How can they do DUI when he hadnt smoked in hours? He wasnt planning on smoking and driving but the cop called us liars when we said that. He made my friend go through a series of tests. He did the alphabet backwards which i cant even do not stoned, stood on one leg and counted from 1001 to 1060, stood with his eyes closed for a while to test balance, and some other stuff i forget. The point is, he passed all the tests. He asked how can the cop say he was driving under influence, and the cop responded that he could make him take a piss test and it would come up positive. How the f*ck does that prove that he was driving high? The thc in blood coulda been from days before. heh and what sucks more is i had throwing knives on me which are apparently illegal in ny =/ |

| As far as I know a police officer can only search you, and your vehicle, if there is probable cause. If your car smelled of marijuana that's enough to constitute probable cause. As far as two grams is concerned. The normal penalty in NY for such a trivial amount is $50.00, but a DUI is far more serious. Though I doubt that the charge will stick without concrete evidence that your friend was driving under the influence. |

| If you guys were parked when he pulled over, I bet the charges will be dropped. He obviously searched you with no probable cause.

| unless you were recklessly driving/speeding on ur way to the parking lot, or had any drugs or paraphenlia in open view when the cop came over, you have nothing to worry about. the only justifiable reason i can come up with is if the driver had a jr. liscence and it was after curfew when this happened, and you had to be escorted home by the cop. then he has the right to search you since he's putting you in the backseat of his car. but even then unless you were speeding or driving recklessly right before you parked and he saw you, there's still no reason to legally search ur car. |

| i had the knives in my pocket because i use them for target practice much like many americans use guns and practice shooting cans or other targets. The cop didnt believe me, but the truth is i had them cause i went over to my friends house and used them there and forgot to leave them in my car or at the house. they are so light and thin u dont really notice in loose pants. And the cop was dumb cause he called it a dagger even tho i explained how it was a throwing knife. A dagger must have a sharpened double edge blade where the sharpened part exceeds an inch in length on both sides. These are 7 inch knives but only 3 1/4 inch is considered "blade" even tho edges arent sharp...only 3/4 inch of tip is sharp so it sticks in targets, supposedly to be under regulation and legal. However I guess any knife that can be thrown is illegal here in NY, despite the fact that i could use any balanced kitchen or steak knife to throw too. Hell, i coulda had a pocket full of razor blades / box cutters and been let off the hook cause those are legal. |
