I'm not sure if this is the right place to post this, but here goes anyway. In about a month I'll be putting in an application for an apartment. I've read something about a drug use questionaire being part of the application, and my applicaion could be denyed b/c of a "yes" answer. My question is this: since I don't have a record of use (nothing w/ the police or parents, only close friends know for sure that I smoke) what kind of trouble can I get into for lieing on the application? Obviously eviction is a concern, but being caught even for the first time would be cause for eviction anyway. What other actions could be taken against me for false information given?

First of all, I would get a copy of the application. You hearing that there was some drug questionaire will make you worry about it until you have seen it.

I personally would not admit my usage on an apartment application. I don't think that I would even apply for an apartment that asked. (I am just like that)

Unless they are going to do a drug screening on you, (I am sure that they probably will not) how are they going to know?

What kind of trouble could you get into? I am sure that the absolute worse thing that could happen is that you get caught smoking, and they call the cops and after that evict you. Just be smart about what you do and be respectful to your neighbors and managers. You shouldn't have any problems.

Post Questionnaire…

If there is such an application, I'm sure chosing the "Yes, I use illegal drugs" answer will disqualify you from being considered as a tenant.

Why do places have these types of questionnaires? If a mj user responds honestly, he or she won't get approved…don't these people see the logic of that?

I've rented lots of apartments and I have never seen this. Even if there is a question about drugs and you check "NO", I don't see how you could get into any kind of legal trouble even if they did find out down the road. There would be no way to prove that when you filled out your application you were using drugs. And if an apartment complex asks for a drug test then by all means find another place to live!
Just use good judgement while living in your apartment and you'll be fine.

Whatever realty/property management company that controls that apartment complex obviously has too much time on their hands…Who in their right mind would pose such a question, and expect an honest response?…

Sure, if it was a physician's office or medical establishment, which may require all information on drugs someone takes, that's another thing. But to expect prospective tenants to give straight answers to such a ridiculous questionnaire is laughable

You don't have to worry about a thing. Geez, man....just mark that you don't use drugs. Do you really think you could get in any trouble? And I've learned it probably doesn't really matter what you do....nobody who works at the appartment complex is going to care unless they are like a manager or owner. The service people who work here at my complex have seen our bongs/pipes/weed many many times. They don't care...they all smoke themselves, or at least used to probably. At my past apartment complex, my roommate and I used to sit out on our patio smoking while the security guard and service personnel drive around. They don't give a sh!t what the hell you're doing. Smoke, have fun, relax, lie on questionnaires, everything is fine.

You are delusional Johnny. The maintence people are the eyes and ears of the management. Never for a second believe otherwise. Just because nothing has happened does not that they have not told the property manager. and they just choose to do nothing about it at this point in time. But you should bet that management knows of the habit.

There is a valid reason why there is that question on a questionaire. 1> To get all the suckers out of the way, and 2> to act as insurance against a possible police action later on. Say if you were caught growing and the police wanted to seize the property after a bust, they could pull this out and ... well you get the picture. A cover their ass kinda thing. And of course the fact that you lied on your application may be used in your trial later on, if the judge allows it.

But lets be serious for a second here. Do they really care if you occassionally smoke a joint? Appartment people are more concerned with how the property is maintained and the timely payment of rent rather than what you do in your living space. If it becomes a problem, people going in and out at odd times of the night, loud parties, and disrespectful behavior in general then yeah, you can get evicted, but you can be evicted for these things reguardless of marijuana useage or not. There is a lot of hassle to evict someone, and evicting a peaceful quiet pot smoker who pays his rent on time and keeps the inside well (no holes in walls or marks, spilled bong water on the carpet etc.) then it just really isn't worth the effort. Expecially when you could get a drunk to fill the space who never pays his rent and tears the place up.

Be cool, and don't be obvious, and don't leave your stuff out. You should do these things reguardless if you rent or own. Remember, the squeaky wheel gets the grease.

Personally, I would check no on the questionare and think nothing about it. They have to be stupid to expect you to put into writing that you do any illegal activity. They probably realize this as well. Just because they don't mention anything about it when they hand the slip to you does not mean that they don't disagree with it.

And one last free tip, it pays to occassionally stop in and try to get on the good side of your managers. Go down in person to report a repair and chat for a bit if they are not busy. The more they get to know you as a person, the less they rely on what you have written on the paper.
