| so tuesday night at 2 am me and 2 friends, a and b were riding around our local town. we went to a park to smoke but were interupted when a cop pulled a guy over up the rode. we saw the flashing lights and retreated to the safety of our car. we flew out of the park and went down the rode. 5 mins later the supercharged asshole state cops were up our ass. the same one who was on a traffic stop 5 minutes ago. now this was a long ass ways away from the park so he must of done 120 down thi swindy back road to catch us in the short amount of time. he put his lights and siren on and pulled us over. he said our tailight was out and asked to see the usual paperwork. before he pulled us ove ri jammed the bowl and weed under the back seat to hide it. he told my friend b who was a passenger to step out of the vehicle and answer questions with his partner. he told me that with all the moving around there were safety concerns taht we are hiding weapons in the vehicle. he grabbed a backpack that was next to me and began to search it. he found a huge ass steamroller named the intimidator and came back to pull me out of the car. i went over the the cop car and he patted me down liek i was being arrested. he began to ask me questions like whos bag was it whos SR was it and what not. i said it was b's bag but i didnt comment on the SR. he asked where the rest of it was. he threatend me by sayinghe will impound the car and tear it down. i stupidly said under the seat and he retrieved the remaining weed. i think he found the bowl but threw it out as to not be a total asshole which i will find out in a few weeks if they have it as evidence or not. the driver, friend a was told to leave and me and b were escorted home in the car. i came home at 2:30 am with 2 state troopers. one telling my mom taht i was pulled over and a small amount of marijuana (3grams or less) and a 'Huffer" (a large pipe lol) was found on our persons. he said we will be contacted soon with me and b's punishments since we are only 17. the driver, a, is 18. i was told i will get a fine, 6 months probation and anti drug classes. can anyone help me out and give me ideas on what to do and what will happen. its really important. my mom flipped **** and thinks im ruining my life... thanks for everyones time! |

| Hate to tell yah, but whatever you "hear" about what will happen to you really has no ground. When I was busted I was told Id get 6 months probation, drug classes, and a fine, what I was actually hit with was 5 months of diversion (a very weak version of probation), a fine that was twice as high as I had been told (by people here, various web sites, and friends that have been through it before), and now I just found out that I may end up on informal probation for a year (still havnt found out what it is, thread only has 1 reply). So you wont know whats going to happen until it happens. Do to your age, the judge will most likely cut you a deal, make you jump through hoops so you dont have to pay the fine. If your still in school, study up, cus he'll most likely make graduation part of your probation/diversion/informal probation, wich ever he gives you. When it comes down to it, you'll probly have 2 choices, fight it (if you left out something, eg he didnt have probable cause, or whatever) or bite the bullet, I chose bite the bullet because fighting it gives you a %50 chance of digging a deeper hole, and seeing as how the system has the upper hand, just eat it and dont get caught again. |

| you should have told him he is not allowed to search your car. unless a cop has your permission, they can't search.

| We as citizens give cops certain power that now one else has. Sometimes the cop will abuse their power. For all of you that got out of sh*t becaus the cop was cool or lazy, probalbly don't realize that he was abusing his/her power too. Reguardless of anyones view of marijuana you were still breaking the law and the offiecers were doing their jobs. Your best bet is to just eat it because you gave him permission to search the car and he will just find a way around the illegal search and siezure, because you were still breaking the law. Sorry if I sound like an asshole because I totaly know what it feels like to get busted. There is nothing more huiliating than having to have your parents woken up at some ungodly hour to come and pick your drunk or stoned ass up. Just do what the judge says and try not to get busted again. Good Luck |

| sometimes the police can be bastards...but as log as it desn't smell like pot and everything else on the car is legit they can't search...just say no to warrantles searches...search www.yahooka.com for some cool info on that |

| thanks for all the advice. i am going to bite the bullet as you put it. i plan on having a ua in a few weeks to prove i wasnt smoking. i also plan on telling whoever askes (the judge, a councelor whoever) that nothing in the car was mine. im letting my 18 year old 'friend' fight his own battle. im just concerned about me and my underage friend. hopefully i will get out of everyhting with just a fine or something if i can prove i was just in the wrong place at the wrong time... |

| I must disagree. You would be much better off searching this forum for threads about what constitutes a valid search, probable cause and the like. Niteshift has provided this forum with a large amount of accurate information on multiple occasions. I don't mean to bash yahooka but you would be doing yourself a favor to look through this forum instead. For example: Quote:

Taking an aggressive, combative attitude with the judge, your parents and everyone else is only going to make them come down hard on your ass. The judge will have no qualms about nailing you twice as hard if you get flippant. He has you by the proverbial balls presently. Don't give him/her a reason to squeeze. Think of this in terms of the advice alot of us give people who are able to walk away from an encounter with an LEO minus some weed. Count yourself lucky given what could have happened. Just my two cents for what it's worth (ie about two cents).

| Well, you really didn't mention him asking you for permission to search the car, so I don't think it's fair for people to bash you for letting him search the car. If he's going to search it without asking, chances are that he feels he has the probable cause already (Which I would have to assume was the moving around? Weapon concern?) If he starts searching without asking, your silence is not permission to search. If he's going to search without asking, you may as well just cooperate - he won't stop because you demand that he stops. I've found (through my own experiences) that if they suspect some sort of drug issue, a less ethical officer will break out that weapon safety concern act to try and search as much as possible. They're allowed to do that, to a certain extent (read up for more details), because after all, it IS a legitimate concern. I get burned when I know they're using it to look for other stuff. It's happened to me and it really pissed me off. If you feel that you've been wronged in the search, you'll have to attack it from the angle that the original search was illegal. I don't know that shuffling around in the car implies probable cause, but I don't pretend to be a lawyer either. Good luck. |
