| if you are fired because you fail one of those cursed random tests, is this information that your former employer is allowed to give prospective employers? does this vary from state to state? any good resources that speak in non-legalese? | |

| This is confidential information and will not be released to a future employer. If you do have a former employer that releases this information, get an attorney. By law, companies are not even allowed to give negative recommendations regarding your employment. They may phrase their reply in a way as to make it appear that you did not perform well, but no specifics. Employment discrimination suits are something that companies want no part of. Incidentally, I was fired for a positive test. I then went to work for a Fortune150 company who conducted a pre-employment drug screen as well as a background check. No problems whatsoever. The only outside agency made aware of the failed test was my state's unemployment agency when I tried to file. | |

| it comes down to this what the company policey is. its in teh FINE print on contarcts and applications each company is diff. |
