| Sweet, I get to make the first post here. OK, anyway, like alot of schools mine uses police dogs to sniff for drugs. Although I've never brought any herb to school, I might sometimes in the near future(the dogs only come like once a month). But I was wondering about my rights in this situation...I know it's not considered unreasonable search or seizure 'cause the airspace around you is considered public domain AND when you walk on school grounds you forfeit certain rights(any links to legislation on these laws would be helpful). But my main question here is, and this is kinda crazy, could I "escape" out of a situation with these dogs without dire consequences. Let's say they came into my classroom and started sniffin me and actin weird, so the handlers(who are NOT, I repeat NOT police officers) ask if they can search me, I refuse and they say they can do it anyway because of the afformentioned laws. So, once again this is kinda crazy, I jump out of my seat and haul ass out the door and off school property(I think I could do this, 'cause the handlers are like middle aged women and I run track). My question here, are the handlers(who aren't police officers but may have some authority) or the school personnel authorized to physically detain me or my belongings. AND if/when they found me and I had dumped my stuff, what is the worst that could happen to me besides a drug test and gettin burned for leaving campus. Any help greatly appreciated!!! | Well, if they're requesting permission to search you, that gives you a big hint that you can answer "no". But, with dogs, they have probable cause. The only problem with using dogs is that you can't really perform random searches with them - I think. There was an article about it posted several weeks ago on here. I'd like to see a list of the rights you forfeit when on school property, too. | |

| tell them you want to call your parents first and when they start you down the hall take a run for the door if you get away they can only suspend you for maybe a week or two at the most they must have physical evidence that you had weed on you to press charges or expell you and since they are not police the whole evading police or resisting arrest thing wouldnt be an issue | |

In fact, they have greater powers of search than I do as a police officer. "what is the worst that could happen to me besides a drug test and gettin burned for leaving campus. " Probably the worst is expell you. However, if you touched any of them in my state, you'd get charged with battery on a school employee, which is as serious as battery on a police officer. | Actually, I didn't forget it, I just quoted you so that you knew what I was referring to. It's a bit different from state to state. In my state, for example, it's the opposite. A school employee (teacher, dean, security officer) can perform a search "just because", but as a police officer (even the ones assigned in the schools), I have to follow the same rules that I would for searching anyone. |

| One time I was carrying about 3 oz on me, in a backpack, when i still was in high school of course, and the principal put his hand on my shoulder... "smells like i need to see that backpack" now, there were two things i could have done... I could have let him find the 3 seperately wrapped oz's and consequently been arrested for possesion with intent to sell most likely(individually wrapped), i was 18 at the time... Or, I bolted. I can't even remember running that fast before... got off school grounds, ran home (only 3 blocks) and stashed it in the backyard (I was a little paranoid). Needless to say, when i went back the next morning, actually even before that, they called my parents, I was in a world of sh*t. I think i got suspended for 14 days, and they even brought in a cop to lecture me on the differences between being an 18yr old adult, and a kid. I never did get into any trouble for the buds tho... They kept me company while i enjoyed my suspention. ![]() I say RUN FOREST, RUN! | |

| Banned | ^lol thats a good story mayne i don't go to skool with a lot of herbs... but if im just chillin and i have a big quantity of weed on me i can smell weed everywhere i can imagine how much 3 oz would smell like in a backpack... |
