Heres just another story of someone getting busted for driving and smoking. Last night i was with some friends and we were just driving a couple blocks to a different party. So one of my friends in the back of the car lights up a joint and i told him to put it out but he wouldnt listen. I was like whatever when I get to the party in 1 min then ill just beat his ass. So im just following the traffic going about 70km on a 50 road when a cops put his sirens on. Of course im ripped outa my mind and everyone in the car is like pull up in the parking lot just down the road cause i wasnt sure if i should pull over on the road cause there wasnt really anywhere to pull over. So when I get to the parking lot the cop comes up and when i roll down the window the cops like theres enough marijuana to get me high in the air!! He asks us if anyone has any marijuana or pipes and he says if we admit it now we wont be charged. So my friend sitting next to me gives the cop a pipe and he says i know theres more weed and im calling a back up unit to search the car and you guys so you better give it up now. But no one gave the rest of the weed. So when the other cop car gets here they start searching us first. they like strip search us and dont find anything. Then they search the car and find some firecrackers and a joint under the seat. So the cops tells me that its my responciblity for the weed and if know ones admits whos it is im going to get an other ticket for weed so my friend admits that its his and doesnt even get a ticket. They take all our names and phone numbers and they said they would not call our parents. On top of that they give me a 173 doallar fine fore speeding. But none of us got charged for anything to do with marijuana. So they let us go. My friends said they would all help me pay for the fine too so its all good. but in the end it turns out that the cops phoned each one of our parents and told them that we were hotboxing the car so were like all grounded.


So im just wondering Should i go to court and hope that the cop doesnt show up which means i wouldnt havea $173 fine cause cops dont get payed over time to go to court anymore so he probably wont show up. But also if the cop does decide to show up will they charge me even more on top of the ticket . And what do i say to the judge. Do i say im not guilty or what. ??/

i wouldn't contest the ticket. you got lucky with just a speeding ticket, i'd just pay that and be on your way

the speeding ticket doesnt say anything about smoking weed so they cant just bring up the weed thing. Ill just say they dont have proof i was speeding and that i was just following the traffic. My parents got the a speeding ticket for 173 to and they went to court and the cop didnt show so they were let off.

I'm not a cop from Canada, but I have a funny feeling that they are much like the US, so.... BC, where do you get it that the cops don't get paid for their court time? Of course they do I am very sure. As far as the cop not showing up in court, pretty darn sure he would since we all know that is part of the job. Also, by chance if the cop was not there for a good reason (family emerg., etc.) the case (even a simple ticket) could be continued another day. The cop sure as heck can bring up the MJ smoking if you contested the trial. Just because it is not charged doesn't mean it can't be discussed, he simply gave you a 'verbal warning' about it, so yes it can be brought up. Simple example, I have given some people breaks on tickets, only wrote them 1 when I could have wrote 2,3 or more cause at the time they seemed like decent people. Of course I document all of this. Well, we get to court then you see that they are really looking to get out of the ticket and lie to the judge, etc. From there I am able to testify that even though 1 citiation was issued, I could have issued a total of 3 but gave them a 'verbal warnings' instead. Usually then the judge will hit the person with the highest fine based upon the fact they already got 'a break' from only getting 1 ticket, but then they wanted to be fight it, so the judge usually comes down harder. Just curious, how were you caught speeding, on radar or was he pacing behind you? You could have also been arrested for DUI. So that cop probably saved you several thousand bucks by cutting you loose like that, so before you spit into the wind here, think of the consequences. If your story went down the way you said it did, I can assure you, you are very lucky, I am an easy going cop, but I would have done more to you than they did.

Uh i know for a fact that cops dont get paid for overtime anymore for going to court its a new law here now. And a couple of my friends have gotten speeding tickets and the went to court and the cop didnt show up the the charges were dropped. I wasnt clocked on radar the cop was behind me and the cop didnt think i was stoned he just found weed on my friends and smelled weed too. All my friends confessed it was there weed so even if they do bring it up in court i can just say it was my friends and that they even confesed to the cops that it was there weed. As for the ticket i think that outrageuous. $173 i dont have that kind of money and a normal speeding ticket is around 100. Trust me its a lot different in canada. And the cop didnt tell me anything about getting lucky and think he tried to get me in the most **** sa possible. I told him not to phone my parents and he said he wouldnt but he still did. If i do go to court i wont lie to the judge i will just say that i was following the cars behind me. Im just hoping the cop wont show. Cause usually they never do.

Trust me, don't bother fighting that ticket, you won't get off.

The only point in fighting a speeding ticket is to get it reduced, either for the dollar amount, or the points. It's common sense to always fight the ticket, because it will usually be reduced, especially if you have a clean driving record. It is the Crown Attorney that usually does the bargaining, but sometimes it does go before a judge.

In your case, the Crown will know the facts, having talked to the officer beforehand, and will probably not want to cut a deal. You were already cut a deal, you can't push your luck too far. In front of a judge, the other factors will get brought up, and they will not be taken lightly by the jp.

You got off on this one, as best you could. Don't look a gift horse in the mouth.

ya guess your right but im not going to court to bargain with the judge im just hoping the cop doesnt show up cause half the time the cops dont show. Same thing happened with my parents. MY dad got a $150 speeding ticket and he went to court and the cop didnt show. Cause like i said cops in bc dont get paid overtime to go to court.

You don't want to bargain before the judge, but what type of explanation will you give if the officer does show up? You said half the time, based upon your parent's experience, but your parents probably got caught under different circumstances.

If I was a cop, and I cut a kid a helluva good deal, and then he objected to it, I would not be thrilled. In fact, I would be more inclined to attend court to ensure that he doesn't repeat his behaviour again.

On a probability scale, a 50% chance isn't all that great. If he does show, while it is your right to defend any charges against you, the court will not like you wasting their time. If you really want to know your odds for sure, go to one of the traffic defense places, like X-Coppers, or Points (At least that's what they're called here in Ontario). If they don't take your case, your odds of winning are slim to none.
