| ok.. i'm curious how to best handle the following situation: I was at a rave, and of course there were pot smokers all around me... i didn't smoke any, but by the end of it, i smelled like pot. so i'm driving back home late at night (morning), and I smell like pot, but i didn't smoke any, and i dont have any in my car. if i get stopped, what is the best thing to do? 1) explain it all? say there was pot around me smoked by ppl i didn't know, but i dont have any/ didn't smoke any 2) play dumb and act as if i didn't know there was any pot smokers around me 3) what else? |

If I smell it, I have PC to search your car and I may or may not. I might also administer field sobriety tests to ensure you are ok to drive. "2) play dumb and act as if i didn't know there was any pot smokers around me" Bad choice. If you told me that story, the needle on my BS-meter would peg out. If you, as a teen, are going to expect me to believe that you didn't realize everyone around you was smoking pot, I'd almost look at that as insulting me. Be honest, it'll get you a lot further in this case than trying to BS me will. Lying to me just puts me in a bad mood. |

| niteshift .. i heard that if a cop searches a vehicle just because they "smell weed" that they cannot use any evidence if they do not have the proper training for what it smells like .. i forget who it was but i saw that some guy got pulled over and a cop smelled that "oh so farmilliar smell" but he didnt have the proper training to indentify it and he ended up finding pounds of weed in the guys trunk and later they searched his house and found even more but in court all of the evidence was found null and void because he didnt have the proper training so the guy got off .. ur a cop .. this is true right? as if it really matters cause cops will search ur car if they smell it obviously .. but just hoping that maybe ull get off if he doesnt have training for "smells" i guess.. |

" There may be some strange jurisdiction where a judge has ruled that, but no place I have worked has had that problem. However, I'd still win. I DO have the proper training and it's documented. Now, it's acceptable for a cop to say that he knows what pot smells like because he smoked it in HS, but when I got into LE, it's wasn't. So we went to "controlled burns". A small amount of mj was burned in the room and we smelled it, so we could then testify we'd be trained to recognize the smell. If I was in a place that required training of the officer, that would be my suggestion on how they get trained. "but just hoping that maybe ull get off if he doesnt have training for "smells" i guess.." Keep hoping rocketdude That arrest would fly almost anywhere. |

| I'm trying to immagine that training sesion. ![]() I never thought that the ability of the officer to smell pot would be questioned; especially if they found lots and lots of marijuana.

| "I'm trying to immagine that training sesion." Pretty simple actually............a small amount was placed in a coffee can and lit. We smelled it and it was extinguished. At one point in the old, old days, new narcotics officers were allowed to smoke a joint in training to be able to recognize not only the smell, but the effects. Watch the movie Serpico sometime, they even showed it in there. This training is no longer needed anywhere I know of. Now, the courts generally recognize an officers ability to recognize the unique smell. Also, now, most depts. will hire an officer that admits to smoking pot in high school or something like that, so it's not really an issue anymore. |

| what about the college classes niteshift do they also test burn the smell for the recruits? the college i went to, like clock work every sem you could walk down this 1 hallway where the LE program was and you could smell the odor of mj |

| If a cop smells marijuana on you.. he cannot do a thing except ask if he can search your vehicle/body. Its not illegal to smell like marijuana, its illegal to possess it. One rule I have is that if i'm going to drive anywhere, I make sure its an amount that I can eat at any time if I get pulled over (joint, gram nugget, etc). Also if the officer says he smells "burned" marijuana.. He's pretty much has screwed himself because hes admitted to it being disintegrated/dissolved into the atmosphere in which case; it doesn't exist and you do not own air my friend ![]() High Times > Canada: Smell of Weed No Longer Grounds for Arrest, Search |
