| Lets say I am outside smoking a joint. I am sitting in a park with noone else around. I am half way done with the joint when a cop taps me on the shoulder from the back. I quickly swallow the joint. I then turn around to face the cop. (Nothing on me except what I just swallowed.) If this is the situation. Can I get arrested for something? They can't arrest me for possesion since i dont have anything on me except that joint that I swallowed. Can't get arrested for smelling like it. Is there something that the cop can get me for? | |

If the cop was close enough to tap you on the shoulder he's already seen you smoking SOMETHING and smells marijuana, furthermore if he taps you on the shoulder and then you swallow it, he's seen you swallow which he is very sure was at some point a joint. PS Why would you swallow a joint that's lit? that could really hurt |

| Peezdets, At the Dept I work for policy states; If you observe someone ingest what you believe to be a controlled substance you shall immediately provide medical treatment. That consists of a stomach pump. When the stomach is pumped the swallowed evidence is regurgitated and then recovered at which time you can be cited or arrested for the contraband. Furthermore, the person who is arrested can also be held accountable for the medical bills due to the fact he/she was involved in an illegal act. Oh yeah, if you were thinking of maybe tossing down a storm drain or something, we can still cite you since we observed the illegal act and we would just articulate what happened to the evidence in a report. My advice is that if you feel the need to smoke outdoors then be prepared to pay the consequences, but do not swallow a joint to avoid a ticket. | |

| I wouldn't swallow a lit joint, but the stomach pump and being cited for ingested contents got me to thinking. If a person tests positive on a drug screen for an illegal substance like MJ, isn't that also evidence of possesion? Kind of proves how senseless the laws really are. Maggie | |
