Ok, new thread i got busted and im unclear of how my age is going to stand in court!?

Ok, so i got pulled over for no tag lights, i had been drinking and smoking and had my smoke and the seeds, in 2 different bags. Now the cop didnt charge me with DUI becuase i was driving perfectly fine and i told him the truth, but i still got arrested for possesion under 20 grams. So im in the state of Flordia and i turn 18 on the 16th of may and this occured on the 11th. Im still a juvi. on this occurance correct? and depending on that, what kind of sentancing am i going to be looking at, and do they have the right do recon on me? i need to know these things for an ease of mind, i just like to smoke man. i didnt mean any harm!

Actually, most counties in FL have a standard sanction worked out if you plead no contest. Call the clerk of courts and ask them what a no contest plea would get you and see if that sounds acceptable.

Personally, I'd have been more inclined to pop you for the Zero Tolerance DUI. You lose your license for 6 months, but it's non-criminal, so you don't get a record out of it.

Sorry, i wasnt clear with that. I mean do they have the right to keep tabs on me or monitor me without my knowledge. also since i am a juvi this time, does that dissapear from my record in 4 days when i turn 18 ? i dont have to tell jobs about it? or finacial aid\loan for college?

We can legally do that without you having ever been arrested.

It doesn't actually disappear unless a judge expunges your record. It normally, however, is not held against you.

If the question is "Have you ever been arrested......" the answer is yes. If you say no and they find out, it's grounds for immediate termination in most places.

My advice, be honest about it. Hell, we're talking about possession of mj here, not an axe murder. If, in the current climate, a cop can admit to smoking pot as an adult (but a few years ago) and get hired, why risk getting canned by lying?

Yes, tell them. If you don't tell anyone else, don't lie to the Feds about an arrest record. Not only will they yank your loan if they find out you lied, they can criminally prosecute you.

Another thing, check with the Dept. of Juvenile Justice and see if there is a pre-trail diversion program (assuiming you've never been arrested before) available to you.
