Question

Submitted by Anonymous to the front page of marijuana.com.

"My work has just started random drug testing. If I have a valid medicinal marijuana prescription and they test me positive for marijuana, can they fire me? If I am fired do I have any rights or even a chance of fighting them in court and getting my job back?"

Any input would be great. Thanks Guys

I think it would be best to tell your employer about your medical use of marijuana BEFORE you get 'caught' through a drug test. This way, you can reach an understanding before the test so it doesn't look like you're just making up an excuse.

on the sheet for the drug test, there should be a section for you to list medications that you are taking. If you have a valid perscription or recomendation, write it down there on the form where it asks for it.

I am not sure what legal remedies that you could use if they fire you based on the results of a positive test, that would be something you would want to consult a lawyer in your state about. There might be some Civil Rights Violations if they discriminate against you because of your medical condition, and since most med. marijuana laws normally have something about having to have tried other medications before marijuana, as well as specifically listing illnesses where it is legal to possess and use it in your state there might be legal recorse. Although test cases are normally expensive and you might not be in the position to do that. Another thing to consider is would you get the job if you refused the test?

I agree with Nasarius, you should bring this matter, with the recomendation or perscription from your doctor, up with your employer. It is really up to them what they do with the results of your drug test.

That post is 7 years old and the OP isnt even registered anymore.

Its now known that they can decide to not hire a medical patient from a drug test and most dont.
