I had a run in today in my college dorms with the campus police. Trying not to post a thread that's been posted before, but it was kind of strange because they smelled pot, I signed a consent to search, and they found like 1/4 of a gram on my roommate's bed, and and old busted pipe. He read me rights before the search to be silent, but I waived those rights, and after he searched he said he was going to write something to the DA and the student services, but he never gave me out a ticket. I have friends who have been through similar experiences, and had to sign a ticket for possession. Before they searched they took our names and numbers down and did a background check. Really paranoid about what they'll do. Did I just get lucky and they just took my bud and left, or can they give a ticket later in the mail?

It will most likely go though the judicial affairs though your school. You could have gotten really lucky and got cool cops but i doubt it because if the school happened to find out about it they would be fired or at least punished because of 0 tolerance laws (most likely not set in stone by any means)If it was in your friends weed you have nothing to worry about really unless they can prove that you knew about it. Your friend will most likely get kicked out of the dorm though, school have a 0 tolerance policy. Relatively same thing happened to me, I got kicked out of my dorm, and still have to pay for all of this semester and half of next semester, im on probation and all the fine for that are about $1,400. I live in GA, which is a relatively strict state on weed, from what i have read, so it could be completely different depending on where you live.

Just make sure to check your school mail, i nearly got kicked out of my school because i had no idea i had to meet with judicial affairs.

If they found the weed in your roommate's bed and you weren't dumb enough tell them that it was yours, I don't see how you could be charged with anything.

Me neither but they will still try to punish him. My university loves to do that. "Well you knew about it and didn't report it so you get community service too".

OP:
Were you reported? Did your dormroom smell of pot when they came for the search? Assuming you haven't admitted to knowing anything about it.. I personally would fight anything they try to punish you with (my guess is it's going to be drug class and/or community service, if it's your first offense).. just be clear that you had no idea anything illegal was in your dorm room or even that your buddy used it! GL though, and tell us how it goes!

even if they smelled something... if that was enough evidence for a search, why did you sign the consent to search?

it seems that if you are signing a consent to search, it's because they didn't already have the legal grounds to search.

Actually, nearly every time an officer has probable cause to search, he or she will STILL ask permission, just in case something happens to go sour somewhere along the line. Denying permission even IF they have probable cause is, legally, prehaps the best idea, because you can cahllenge probable cause in court....if they have a signed "permssion to search" form, or an audio/video record of you consenting, well...thats pretty hard to deny in court
