Default Stoned in public?

I'm sure this has been asked before and I'm sorry if it has but the search function isn't working for me at the moment.

Anyway, I was wondering if you can get in legal trouble for being stoned in a public place without any piece, weed, etc. on you. If your eyes were red and glazed and you reeked like pot could any charges come upon you?

I live in Oregon if that matters.

I tried it again and it works now. Before it was saying I need to use more than 4 words regardless of the number of words I used. I tried using 7 words other than "it, and, is, etc." and it said the same thing. Thanks for neglecting my question and being an asshole though.

In many places, public intoxication is considered to be a disturbing the peace misdemeanor. In South Dakota, if you test positive for marijuana, you are guilty of possession.

Same thing in Ohio....if you test positive that means you possesed it so they can charge you with possesion of same and arrest you for the offense, if necessary. Herb is no different...............

Invasion of privacy in my opinion, but since I flunked my judge test I guess it's OK to throw out the Constitution.........

Do you know an instance of this happening? Or a reference in the Code? I've lived in Ohio all my life and read all the marijuana laws in the Ohio Revised Code and never seen anything about it. I've never heard of anyone getting busted for "internal possession". AFAIK, South Dakota is the only state with such a statute.

Possession is such a minor deal in Ohio, it's hard to imagine the police going through this song-and-dance to get a conviction.

Buzzby, how many mornings have you spent in municipal court in Ohio? In our municipal court, it can even be used as a reason for misdemeanor or felony probation violation. If you test positive for meth in Highland county, your bond goes to over $70,000 immediately and you are charged with poss. of meth.

Mairijuana can be the same thing. If you get pulled over and for some reason you are asked for a urine sample and it comes up positive for drugs of any kind, you are charged with O.V.I. and put in the jail if you can't make the bond.......... You do know we have an O.V.I. law, right?


They take the urine screens dead serious around here. It's certainly a law used by our judge and his court vigorously......... It's so prevalent that some refuse the test as a matter of course.........
