Me and my friends were walking around a university smoking a blunt <yes i know very stupid to do>, and a bike cop rode past us and smelled the marijuana. My friend saw the cop radio in something, and we immideatly left. As we were leaving the university cop told us to stop right there. I ditched the blunt in the bushes, without the cop knowing it. There were three of us, and he made us sit on the ground. Two more university cops came, and they said they smelled marijuana on us. They asked to search us, and two of my friends consented to a search, while I refused, because I realized I had a bowl in my pocket, and I was so stupid for carrying it, I didn't even remember to ditch it. Any ways they let two of my friends go without any further incident after they searched them. Me on the other hand, they made me stay, and kept questioning me why I wont let them search me. As I refused, they got one officer to get a small white book, where they claimed it said they can search me, if they smelled marijuana coming from me. As they searched me, they found the bowl, and I was handcuffed. I was issued a Uniform Criminal Citation, and let go. I live in Maryland, and I realize what I have done was very stupid, I should have remained indoors, not to mention I shouldn't have been carrying the bowl with me.

My question is what type of punishment am I going to receive? Should I get a laywer? I am 19 years old, and I have only been arrested once when I was 16 for 4th degree burgulary. My mind has been pre-occupied with this crap since it happened, and I want to know what can I do?

Also, was the police officer within his rights to search me because he smelled a marijuana odor coming from me? I wanted to know if this because maybe I could get the evidence thrown out of court because of illegal search and seizure. If he was within his rights, does the police officer have to be a certified in knowing what marijuana actually smells like, in order to search me. I wanted to know this because, I could persue information on the officer to find out if he is certified of what it actually smells like, rather than just assuming this is a marijuana odor, so it gives him the right search me. I thank you all very much for your help.

I don't know the laws, Verbal, but I don't think anybody has the right to search you without your consent.

Don't they just need to have reasonable cause or something? Maybe it's only with cars, but I thought that cops couldn't search unless they had a reason to believe that you may be carrying something illegal, which they probably did.

Don't quote me on that though.

My friends actually walked down the street, and watched what was happening, and were still waiting until I was released. Also three police officers were there. One on foot, one on a bike, and one in a police car. The university police is a real police force, with guns, 10-20 police cruisers, and their jurisdiction extends to a few miles around the university, and they also receive state police training. <not that I am praising them, I hate cops >
And yes, I regret not running, but I was smacked, and didn't realize that I could have gotten away.

My initial reaction was to say that they asked to search as both a courtesy and as a back-up. But since they dragged out a book, apparently they didn't know for sure.

It's sad that they didn't, because the odor of mj is probable cause. That is police academy day 2 stuff.

Absolutely.

Back in the mid-80's, when I started in LE, that was still an issue in court. We did actually get trained in the recognition with what were called controlled burns. A small amount of mj was lit and we'd smell it. It was then documented in our training file so if the question came up in court, we could show we'd been trained to recognize the smell.

Fast forward to the 21st century........

I don't know of any depts doing controlled burns anymore. The courts have generally held that a "reasonable person" has probably smelled the odor at some point in his life and recognizes it.

There is also doctrine that allows for police knowledge to be transferable. So, if I'm out with a new cop and smell mj, I can tell him that is how it smells and he can then recognize it, based on my training and experience.

Aside from the fact that in many colleges (especially the state ones), they are sworn police officers, not "rentacops"........

Your attitude will get you into more trouble than your "swiftness" will get you out of.
