|  If you don't have bud on you then you won't even go to jail. Chances are if you were just stoned with no paraphernalia you wouldnt even get a ticket. Depends on what your doing at the time though. |

| umm... i dont think you would go to jail for being under the influence, unless your driving, or causing danger. They may lecture you, and if your a minor theyd probly notify your parents. On the other hand, if you actualy have weed/paraph on ya.. then youd be in trouble.

| they can't even tell if your stoned, so just don't get caught. i've been pulled over several times randomly and the cops were very friendly ( and so was I, haha ) |

| If your state has a law against being high or intoxicated in public (like CA and TX do), it is most likely a misdemeanor. Some states (like FL) don't have a law like that and the arrest would be based on your conduct, like being disorderly for example.

| They will base it on the evidence. Something you may not have heard of is a Drug Recognition Expert (DRE). DRE's are very well trained and give a complete battery of tests, including things like heart rate and muscle rigidity to determine which drug in particular you are under the influence of. Given the depth of their training and documented experience BEFORE they start doing testing on their own, DRE's are VERY well thought of in court. |
