Default Question on Probation Violations

Ok so here is the deal. I have been on probation for about 6 months now for possession of less than 1 oz of MJ, and just 2 days ago i was arrested for going 35 mph over the speed limit (105 in a 70), failure to maintain lane, and failure to stop at a stop sign. Now i know this was really retarded, especially since i did not need to go anywhere in a hurry, i was just getting bored of driving the speed limit for 3 hours with no traffic whatsoever. My question is, Is this a violation of my probation, is it possible for my probation to get revoked and i have to spend the rest of the sentence (6 months) in jail? If my PO asks if i have been arrested, should i lie and say no.
I got arrested in a different county than i am on probation in, but it is the county right next to it.

I have already paid the $1,840 in traffic tickets, do i still need to show up to court? The cop let me keep my license for some odd reason.

Im guessing you are going to tell me that it is all going to be up to the discretion of my PO, but i just want to make sure that i am not royally fucked for sure.

1 more thing I live in Georgia, if that is going to help.

You were going over 100 mph, didn't stay in your lane and didn't stop or even (I am assuming) slow down for a stop sign? Why? Because you were what?

BORED!!!!???!!!!!

You want to know if this is a violation of your probation?

You should be asking your attorney.

I am sure glad I live over 1000 miles away from you.

You say you were arrested. Were you arrested or were you merely issued a ticket?

Next time, when driving that fast and recklessly, when you hit that family crossing in that intersection you blew through and are issued a reckless driving or vehicular homicide charge, you can ask your question from prison.

First thing, I live in Ohio, so this may help you or not. I believe you signed a paper as part of your probation stating that you would follow all laws, and report all contacts you may have with law enforcement to your probation officer within twenty four hours.

If you lie and get caught, that is a probation violation. Speeding won't get you in near as much trouble as not reporting it to your P.O. At least that's the way it is in Ohio......

Take this however you want to, but your on probation already, why do stupid things that will only get you in more trouble? Tell your P.O. Call him right now and tell him. He will probably have you drop urine, and he may ask to see you today, but he will cut you slack if your up front with him, I do believe......

This was a deserted highway, there was no one on the road but me and the cop, i would never drive that fast in traffic. And i just went into the probation office today to pay fines and whatnot but i didnt even think to tell them. I will give him a call tomorrow

Damn dude, they really hate those, "Gee, I forgot to tell you about this bust I had the other day," telephone calls. You have just fucked up his week because he is going to have you come in and grill the shit out of you maybe.

At the least you've just given him a reason to be eyeballing you. Please dude, walk that line and stay clean. The alternative could be bleak.....

well i wish i would have checked this earlier today. i havent smoked since i have been on probation until today. Im really freaking out now thinking this was another horrible decision ( i havent been tested in the 6 months i have been on it, and i just went in today and everything was perfectly fine). i should be clean again in a week, but i looked through all the paper worked i signed and none of it said anything about reporting run ins with the law surprisingly.

Speed limits are not just because of other cars on the road - they are because of the engineering design and maintenance of the highway, too. And the human ability to respond to the conditions, like that truck a mile ahead of you spilling it's load, or the guy going the other way being drunk. Do you know what a caltrop is? At over 100 miles an hour it could be fatal. Slow down.

Nevertheless, I would agree with dedbr, you are in a heap of trouble with your PO - and count on your PO already knowing by tomorrow. Somehow I think you knew you screwed yourself and figured the testing dirty tomorrow won't matter, because you are busted anyway.

Such incident records have been kept statewide since the 1950's, and nationally since the 1980's (instantly with current system), so the Officer likely knew about your probation when he ran you during the traffic stop. If he is really pissed he will personally call your PO, otherwise the system will flag your record and automatically report to your PO; either way your PO will know very shortly and he would have rather heard from you personally.

Think about it, what good would a probation system be if you could just cross the County line? Do you really think that the legal system is so compartmentalized? You must understand that you name is in a national database - you are flagged.

But there is something fishy here - usually traffic fines are not paid to probation, and two days after the citation? Methinks there is a little white lie in here somewhere.

No no white lie. I didnt pay the traffic fine to probation. It was paid to bail me out. I went to the probation office to pay my fine and turn in my sheet that said i completed all my community service a day after the incident and they said nothing. I told the officer and jail nothing about being on probation, because they did not ask. Im sure my PO is going to find out soon enough if he hasnt already, so im keeping my self diluted starting right now for about a week. Its going to be a pain in the ass pissing every half hour, but its worth it. I just hope i dont end up in jail for a long time, i have to go to school.

The highway wasnt completly deserted, just on that stretch of road there were no other cars around me. I was already starting to slow down right as the cop tagged me, not that it makes it any better. It was a really stupid decision and now im going to have to face whatever comes to me. If im asked about anything i will be completly up front and honest about everything, but until that happens im not saying anything. The longer things stay "normal" the better.


1 more thing i should add: My family hired a lawyer that is trying to get the arrest completly thrown off my record not the ticket just the arrest, but it wont happen until my court date (Feb 20).

Thank you for everyone's help on this one. I really fucked up, and im glad there is a community here that helps people like me.
