| Hey guys, anyone reading this thread please give me feedback. I would love to know what this all means and such. Ok, so today my mom got a letter from the sherriff's office saying that they have a warrant for her arrest. It says it can't be handled over telephone, but must be in person. It also says for her to go to the office, so they can do whatever. If she doesn't go to the office in 5 working days, they can come to the house to arrest her. So my question is...if it's just a warrant for her arrest, is it at all possible for the police to search the house for any reason? I'm not positive, but I think that it's all because of bad check(s) she wrote a long time ago, or recently. I live with her, and she's not the most honest person so I don't know what to believe really. But if it was for drugs or anything like that, would it still be handled this way? If you're still confused or I put this wrong then ask questions, I'm seriously considering getting all marijuana and pariphenalia out of the house to a friend's house. | Well if your mom doesnt go in 5 days and they come to the house to arrest her then they will probably have a warrant and there is a possability that they might search the house. |

| I am paranoid. If I was in this situation, I would definitely stash the weed/para somewhere else. That way, you don't have to worry. If they don't search, you can get the stuff back. If they do, you are clean. It is worth the short amount of time to clear out your stash. If your mother does go, it will probably blow over (relatively). It isn't murder, so they wouldn't have too much reason to search the house. If it was theft, or something more serious like that, they may search. If it was drugs, I think they would search. In conclusion, clear out. Would you rather worry and run the risk of being caught, or be able to relax and still have your stuff? I'm very paranoid/cautious, so do this if you really don't want to be caught (not like anyone does...)

| once upon a time a friend and his g/f bought a car with phony credit references..but it went thru, and they got the car.. a few months later, they got a call from the dealership saying that there had been a recall on something in the car, and to bring the car in at their earliest convenience.. well, they got there and handed the keys over to the people at the dealership....then the dealers told them that their lie had been found out, but as long as my friend and his g/f didnt cause a scene, the dealership wouldnt press charges.. so, they may just be too lazy to come get her themselves, or they might actually be willing to clear it up peacefully, (i.e. no jail)... the decision is hers, ultimately, but id suggest that she goes there to handle it..always better the easy way, if possible, once your caught...just have her call a lawyer beforehand and have their strategy straight, because once inside, everything becomes more complicated. *the preceding was a public service announcement from DEEZ NUTS* ![]() EDIT: oh yeah, and to address the original topic....YES, clear everything out, just in case.

In most cases, by the time a warrant is issued, the defendant has failed to make any attempt to clear up the problem. They've avoiding paying fines, failed to appear in court etc. if it's just a warrant for her arrest, is it at all possible for the police to search the house for any reason? It depends on if they find her or not. If they come to the house and she answers the door, then they MOST LIKELY won't be able to search your room. I say most likely, because I don't know if there will be a seperate search warrant or what the physical layout of your house is. However, if they come to the house and want to search the house to see if she is there, then they can search anywhere a person could be. And that is a lot of places. In the process, anything they come across while looking in those places is considered "plain view" and can be used as evidence against you. I'd clear everything out.

| Yes, what Nightshift means is, suppose the police got a search warrant and they were looking for a stolen 50" T.V. If they find weed in the living room while they are looking for the stolen T.V. they can press charges and use this in court. This is because a living room is a reasonable place to put a 50" TV. But if the police start searching drawers and they find weed there, they cannot use this against you in anyway, because a reasonable person would know that a 50'' T.V. cannot fit in a drawer. But I am not sure if they can consficate it, Niteshift? |

| Well it's been about a week since the letter arrived...and I didnt see a single police officer! Now I'm gonna go get high guys. I've never been quite so happy! Thanks for all the help! |

If the search warrant were for drugs; drugs can be hidden damn near anywhere and they'd be able to search nearly everything imaginable, from your toilet tank to books. Whatever else is found in the process, even if it's not drug related, is considered plain view and you can be charged. |
