I was recently arrested for simple possession in Suffolk county, NY I believe 221.05 is the penal code. I know it was a violation, not a misdemeanor or felony. I have not hired an attorney yet and am wondering what I'm looking at as far as penalties/attorney fees, etc Also if this will come up during pre employment screenings. As luck would have it, I'll be out again in the job market shortly. I was previously arrested for possession in 1993 and plead to Disorderly conduct..also a violation. the arrest in 93 was for misdemeanor possession. I appreciate any advice or help.

I don't know much about the laws in your area but a few friends of mine were arrested for possession last year. Each received slightly different penalties, the worst of which included a 6 month license suspension and a whole summer's worth of community service on top of a 500 dollar fine. He was the only one over the age of 18, first offense. I would imagine since this is your second offense your penalties could be a mite more harsh. As for the attorney fees I would imagine they would total in the area of a few thousand. Don't take my word as fact though.

thanks for the advice I work in the banking field. Drug testing is the norm as well as background checks. my 93 arrest never came up on a pre employment screening. At that time, my attorney told me it wouldn't because it was just a violation. I'm hoping things haven't changed since then
