| Hi everyone.. I'm new here. I have a question for anybody out there. I know it's stupid, but I got busted for a dui 2 weeks ago in California (I live in Arizona). I blew a 1.11.. and the cop that pulled me over was a real dick! Not only did he test me for the alcohol but he made me take a drug test!! Unfortunately I had to take a piss test and some other random tests. It sucks because I didn't know that you could refuse to take tests from cops if you wanted to until after the incident. I was naive.. The question is will I have to take any further drug tests before my trial?? Is it safe to blaze up?? Or am I gonna have to worry about another damn test?? Fortunately my parents are getting a hot shot lawyer for me.. a lot of $$$. Does anyone know what will probably be the outcome of the incident?? I'm only 19.. will that make a huge difference?? Any help is appreciated.. I'm really stressin |

| Hey man, I didn't realize the heat could piss test...especially since you were pulled for a DUI, I thought one could refuse to take any tests, but you lost your license...but since you moved, I don't know how that works............................. ![]() |

| I didn't move to Az after the incident. I've always lived in Az. It just so happens I got busted on my way back home from Cali. About the piss test... I didn't know that I could refuse it till after the incident. I also still have my licence.. it will probably be suspended in cali till im 21 though. I don't really know till my court date. My question was if I was going to have to worry about any other drug tests. Also if anybody was in a similar situation that would know the probable outcome considering the factors...thanks in advance |

| I remember years ago when I was living in CO, I was about to go to court for the same thing and a year's driving suspension was mandatory...I flew down to Atlanta, where I had a few friends living, went to GA-DMV, took the driving test, turned in my CO license, and gave my buddy's address for mine...flew back to CO and waited for my GA license that my friend sent to me when it came in his mail. I drove that whole year with a GA license, and never got stopped...but then again, that was 25 yrs. ago....... ![]() |

| I was under the impression that if you refuse to blow here in fl, there is (in theory) no evidence for the state att. office to use against you however, you lose your hipcard for a year. I also thought the urinalisis only applied to dui involving drugs and that it could also be refused. ![]()

| Here in IA we can ask for Breath, Blood or Urine. It all depends on what is going on. We have Drug Reconition Experts (spelling?). They run you through some test and can tell if you have been useing. They also can tell what type of durgs ie.. Cannabis, stimulants, ect... These officers are used when we feel that someone has been useing drugs and the alcohol or lack of alcohol is not the reason they look impared. In IA if you refuse to take any test requested you get hit harder on your license then if you take the test. So most offten it is better that you take the test. But talk to an attorney if you question any thing that is going on. |

| in 1973, I received a DWI (that's what they called it back then) and was convicted...the sentence was $50 fine and 4 points on my license...no license suspension, no jail, nuttin'...now one's life is ruined for about 5 years...now, if your drunk, get behind the wheel and get in an accident, jail time would be appropriate... ![]() |

In fact, nearly half of my DUI arrests refuse the BAC test. But in many cases, I prefer they refuse. Then the case really hinges on what it should hinge on: bad driving and poor performance on the field sobriety tests. It eliminates all the stupid lawyer tricks about the machine and harping on the number ( he was ONLY a .09 )I have, at times, encouraged people to refuse it. If they do, I can take my time at the scene. No hurry to get them to the jail. however, you lose your hipcard for a year. Yep. And you're no eligible for work permits etc. as soon either. One of those would be an accident involving serious injury. If there is a serious injury, I can ORDER blood or urine testing. I can even arrest a nurse, paramedic or doctor that refuses to draw the blood. Injury accidents are taken VERY seriously. |
