I work for a small clinic that has recently been bought by a corporation. We were not tested under private ownership. Nothing has been mentioned to us so far by the corp about testing but we have feeling that it may happen. If there policy is to test do they.... 1. have to test EVERYONE in the clinic including docs and owner, 2. have to give us advance notice since we have not been notified of them req drug tests and how much notice or can they walk in and request a test, and 3. the corp is based out of another state but what state's laws/regs apply regarding testing (if this is not by fed laws only) the state of the corp or the state our clinic is in? Any info would be greatly appreciated. Kinda freaking out!! Thanks in advance for the help!!! ![]()

Well the answers to your questions all depend on what the corporation that bought you decides. You could try going to their website or talking to someone thats worked with them before. But if they do spring one on you real fast I would probably just play sick for awhile to try and get clean, or to plan to dilute or sub your urine. Edit: I confused myself reading your post before, I don't know the different state laws about drug testing but I would guess they favor the employer, not the employee. Every job I've ever had it seems like they just did drug tests as much as they felt like, or had the money to do, and no laws stopped them. I guess you're in Texas what state is the corporation based in? Last edited by Amdro : 02-28-2008 at 03:48 AM.

"Texas law contains no general provision related to drug/alcohol testing. However, employers with 15 or more employees who have workers' compensation insurance coverage must adopt a policy designed to eliminate drug abuse and its effects in the workplace. Employers must distribute a written copy of the policy to each employee." From: Drug and Alcohol Testing in Texas This link could be useful too USATODAY.com - Understanding the laws of drug testing Just from reading this and my experience I'm guessing they can test you at will as long as some kind of "notice" is given. This could be a letter saying report for drug testing in 60 days or in 3 days. If you're worried then just stop smoking for awhile, or at least cut back to smoking only every 3 or 4 days so the THC doesn't build up in your system.
