OK, I have had my medical card for about 5 months, and 1 month ago my friends and i got pulled over for smoking in a parking lot, just a misdemeanor possession ticket. I thought I would just pay the ticket and be fine, but I didn't know they suspend your liscense for one year for pleading guilty.
So, the day before i went to court for that, I get pulled over for speeding, cop smells the under 1 ounce and writes another ticket. Now, I have two misdemeanors including one I had as a minor, and HAVE to fight this ticket. Any suggrestions, similar experiences, I know i need a public defender, any other paperwork I should bring in? Is the misdemeanor as a minor going to show up in court, as I don't have it cleared, and am told that it cannot be cleared after you already have a misdemeanor as an adult. Sorry for all the questions, but I am trying to figure out how to handle and WIN this case. Thank you. Oh, and I live in Southern California.

Before we can offer you any advice, you'll have to tell us why someone with a medical marijuana card is being charged with possession.That's exactly what a medical marijuana card is supposed to prevent. Did you present it to the arresting officers?

I've heard that some LEOs will issue a ticket anyway, in which case presenting the court with your medical marijuana documentation should get you off the hook.

You should really stop smoking MJ in your car. I'm assuming your fairly young.
Young + Speeding + Car smells like weed = Merry Xmas for LEO.

No, I told him I had my medical card and he didn't ask any further details, just proceeded to take my stuff. I should have pulled it out I guess. So as long as I bring in my paperwork and get a public defender this shouldn't be a huge problem I'm hoping...

If worst comes to worst and i actually end up with a third felony, does anyone know the specific punishments that come with it?... i have heard about jail time, fines, etc. Thanks

you're looking at a 3rd misd., not a 3rd felony....HUGE difference. In california, I believe they have a "3 strikes" law which means a 3rd felony could be 25 to life if I remember right(EDIT-actually, it takes 2 violent crimes to be convicted under the 3 strikes law)! You WILL NOT be facing that kind of time with any amount of misdemeanors! I just checked cali's laws, and didn't see anything about the penalties increasing with each subsequent arrest.

thanks alot for the replies, I just want to be on top of this and not make any mistakes that would cost me extra stress. I emailed a couple of the CANORML lawyers and got the replies and info I was looking for from that and this site. THANKS!
