ok so i drive with people and smoke. its inevitable for me, it happens.
also i have my mj card.
i know it is illegal to drive and smoke but what if im in the passenger seat??
if we get pullled over and im not driving, is it best to take the hit for all the weed and paraphernalia in the car if i have my mj card and the driver doesnt.???

Medical Marijuana cards are not a get-out-of-trouble-free card. Your question is an indication that you are using the card as an excuse, which will be easily dealt with by the LEO - write everyone up and make you defend your card in court.

This may include you having your Doctor testify that your need is legitimate. As for the others in the car, your card will not protect them.

Consider two scenarios. In the first, you are pulled over by yourself and there is no odor in the vehicle, but the officer asks if you have anything illegal in the car. You state you have your medical marijuana and a legitimate prescription. The card will likely prevent you from any further hassle as you are treating it respectfully and not smoking in the car.

In the second scenario you have a carload of teenage males, reeking of smoke and carrying all sorts of pipes and personal-use amounts; obviously engaged in smoking while driving. One member, a passenger, tries to claim all the evidence as his because he has a MMJ card.

Which scenario is an appropriate use of a MMJ Card?
