| i was high as hell last night but i came up with an idea and was lucky enough to write part of it down.. if it is true that possession is illegal but smoking it is not, say i had a medical marijuana card, and burned weed in a room, and people just so happened to walk in? they cannot be charged, including me, correct? and one more thing. is it illegal to posses marijuana smoke? |

| Its called constructive posession. You had to possess the weed to burn it and inhale it or I guess everybody would have to have a card, but in that case you wouldnt have to worry about possesion. plus you'd have to burn a lot of shit to get a good contact high in a room... Wish it would work though... that would be sweet. That reminds me when I was living in Tucson, AZ if you went to Mexico to drink as a minor and came back to the good ol' US of A drunk you would get popped with Minor in Possesion of alcohol so I guess the same logic applies |

| In some states, like SD for example, even being high is a crime. A positive urine test can actually earn one a possession charge. As far as the law goes, yes, THC, not just "marijuana" is illegal. Marinol, or synthetic THC, is even illegal. Thers no "secret trick"....weed, and anything containing THC, is illegal.
