| I have to smoke in my car one way or another because of who I live with. I carry my bud and my pipe in my car also. I know California has the if its under an ounce its a fine of $100 misdemeanor charge thing. But, can the cops still me because the driving/automobile thing. Assuming there is weed smell is in my car I have half an 8th and a weed pipe?What is likely to happen? Will I get arrested thats my main concern remember I'm in CALIFORNIA My plan is just to not dick them around if this happens and tell them everything because I know lying about it is what really pisses them off and they charge with more BS. | Yeah, they would most likely charge you with a DUI if they saw the material and suspected that you were currently high, 'cuz I'm guessing you would fail any drug test if you've smoked within the last 30 days. Unless they've found a new, more accurate way of testing that I'm not aware of. My buddy was charged with a DUI for alcohol in Cali about 3 years ago. They took away his license for a year, charged him an $800-$1000 fine, and impounded his vehicle. All of which was probably fortunate for him because that accident totaled his car, and it wasn't the first time he'd drive drunk. That brings me to a more important comment. In my opinion, it's really not smart or responsible to get behind the wheel of a 2-ton vehicle and take it up to speeds of 70 miles per hour. I've seen many people explaining that driving high is perfectly safe and go on to say that they drive high all the time. I understand that cannabis affect people in different ways, and that some consumers actually gain concentration that could improve their driving. But the fact remains, your judgment, reaction time, and reflexes could be altered to the point where you are involved in an accident that might have been avoided if you were sober. I'm not going to say that it's wrong, immoral, or even dangerous to drive under the influence of THC. But I am going to ask that you think long and hard when you squeeze in behind the wheel and put the key to the ignition about whether or not your judgment, reaction time, and reflexes could be altered or slowed. Or better yet, just say: "Ya know, I can wait 20 minutes to spark up." |

| It can't be that hard to find a place other than your car. You don't want to get arrested thats for sure. Find some other place to smoke other than in your car, in fact get all herb and paraphernalia out of it. Get a Vaporizer if you need to be more private.
__________________ I only smoke legal herbs, when I come to these forums and discuss things like smoking and the high one gets I'm referring to the feeling I get from legal herbs and have no information on what others are smokeing or reffering to. I don't smoke marijuana but do enjoy discussing and talking about legal herbs and the high from different legal smoking methods and all my post should be viewed in that light. |

| Got any suggestions??? I don't have my own home i'm in a new town so no friends. I'm a female. Should I put myself in danger and go to some place isolated? Where would you suggest i'm open but don't say a friends... |

| Thanks I found this tho... Driving under the influence: It is unlawful to drive while under the influence of marijuana (or alcohol or any other drug) by Vehicle Code 23152. "Under the influence" is not specifically defined in the statute, but is interpreted to imply some degree of impairment. Therefore the mere fact of having taken a toke of marijuana does not necessarily mean one is DUI. For evidence of impairment, officers may administer a field sobriety test. Arrestees may also be required to submit to their choice of a urine or blood test under Vehicle Code 23612. Since marijuana is detectable for much longer periods in urine than in blood (several days vs. several hours), a positive urine test constitutes much weaker proof of recent use and impairment than a positive blood test. If you haven't smoked marijuana recently and are not under the influence, you are better off to choose a blood test, since you will probably pass it. However, if you are a chronic smoker or have smoked recently, you are better off to choose a urine test; even though you can expect to test positive, the question will at least remain open as to whether you were actually "under the influence" at time of arrest. Marijuana in a Vehicle: Drivers found in possession of less than one ounce of marijuana in their vehicle are liable for a maximum $100 misdemeanor fine under Vehicle Code 23222 (larger amounts are punishable under H&SC 11357(a) and 11359). |

| thats gnarly. No idea you could get a dui for driving high. lol you should invest in some tint and just pull over someplace chill blaze hide everything keep windows cracked. would take some bad karma to get arrested for that it seems |

| if your scared to get high anywhere else then your car maybe you shouldnt smoke i know i would be way to tempted to drive |
