There is no way that you can be prosecuted for handing out fliers in public places (not on private property). That's a right guaranteed to you by the First Amendment. If you're not holding, you have nothing to worry about.

One of the biggest reasons there is so little action on the part of marijuana consumers for legalization is that they're terrified of anyone thinking that they smoke pot. As long as the prohibitionists make you think you have to hide in the shadows, they've already won.
