| Okay, so weed's basically legalized in ontario!? Is that what you guys are saying. That if I was in ontario, I could smoke up and not get arrested!? Oh man, if that's true then it's amazing! I hope that bc will adopt this idea. If that's the case, how long do you think it was take for it to become a national law-thinger? |

| Well technically smoking it is still illegal, however it is no longer illegal to be carrying it. I beleive purchasing is also still ilegal as it falls under trafficking. If you're caught with it the police can not take it away, or arrest you. If you were caught smoking it though that is a different story, you can still be arrested and charged, however you will be able to go through the court system and have it dropped, and be potentially able to sue the police for false arrest. Now, you basically can smoke it though, as any cop with any amount of brains would realize that arresting a pot smoker would waste his time and the courts time, as they would have to be present for the court date, and would have to file report after report to actually arrest you, and not to mention the hassle of actually bringing you to the station, and laying charges. -- Put it this way ... I have been taking advantage of this in full force since saturday, and have smoked with police near by (I'm sure they could smell it) yet they all look a blind eye at everything, because it is in their best interest to do so. |

| What do you mean you can't smoke it but you can have it? If your allowed to possess it then you're allowed to possess it while it's burning and intake the fumes if you so shall please.

| We're talking apples and oranges here though... This thread refers to the Superior Court ruling that Ontario has no laws prohibiting the possession of small amounts of pot. That is not a myth, although perhaps I was a little hasty in applying it to all of Canada. It won't take precedence in other provinces until the various appeals on file are heard, then it will probably be used, assuming that the legislation hasn't gone through yet. Decrim is another matter entirely, the legislation was just introduced today, and it will actually be recriminalizing pot in Ontario.
