Weed - San Diego Judge Throws Out Case Against Marijuana Collective

Well this looks like it’s a great week for Dexter Padilla, a marijuana collective owner and cultivator… and not so much for Bonnie Dumanis, D.A. of San Diego.

The dismissal by a San Diego judge of the charges against Mr. Padilla, the president of a medical marijuana collective, following a week long trial that ended with a hung jury after declaring a mistrial Superior Court Judge Laura Parsky took the bazaar, yet welcome step of dismissing the marijuana charges against master cultivator Padilla. Mr. Padilla, the marijuana grower was brought up by the San Diego County DA on charges of possession of marijuana, along with cultivation of cannabis, in January 2011, in his role as president of therapeutic healing Corp. Apparently Mr. Padilla’s main medical marijuana cultivation area was in a San Marco’s warehouse.

The judge in this case, said she had dismissed the charges (after the hung jury who leaned towards guilt with a 7 to 5 vote), based on the interest of justice and due to the fact that the defense had presented more than enough evidence that Mr. Padilla was complying with the Ca. prop to 215 mmj law.

Mr. Padilla’s charges were dismissed on the bases that he was being protected under California’s prop 215,  – he was a qualified patient who performed all of the due diligence in setting up his cultivation, and collectives before he launched both nonprofit corporation.
