| Some of you may have read my thread earlier today about me and my girlfriend getting arrest. http://www.marijuana.com/places-peop...d-morning.html I've been on probation before , and she has to (when we were minors) so we kind of know the system. But we were thinking, a rule of probation is to not have contact with anyone else on probation. And as we both have court dates coming up, we think were gonna be put on probation, for me possibly prop36 and her pc1000. My question is, since were gonna be put on probation we won't be allowed to have contact with each other im assuming. So what if we got married before we are put on probation, will we be allowed to still be with each other? I need some expert advice, and all is appreciated. Thank you in advance, this situation is very important for myself, and my girlfriend.

| not expert advice here, but a guy I worked with had the same conditions and he was out riding in a car with his dad one day. Both were on probation. Dad got pulled over, arrested for DUI and the son was taken in because he violated the terms of his probation. My guess is that they mouthed off to the cops and they laid down the law. Its not Husband/Wife but it can happen with Father/Son

| I just got off probation 6 months ago after being on it for 2 years, my dad was also on probation. And the both of your probation officers knew that. But we never got caught up or anything, we have been pulled over but they never ran our names to check if we were on probation. I posted this thread on a proper forum and got some replies, sad thing to say is if my girlfriend and I are put on probation we won't be able to see each other (says probation), so thats just one more thing I have to worry about when hanging out with her. ![]() |

| the thing is...after your probation...you'll still be married. I don't know if marriage was in your future or not, but do you really WANT to be married? or is it just so you can see each other during probation?

| I'd say get married but I could be wrong legally. What if you get married and they still impose the no contact as part of your Probation? They do things like that all the time. Also, it seems to be the porbation/parole dept. is cracking down on violators in my area. More of our county jail population is in the jail for probation violation than anything else......... Damn shame all that money is wasted on that pot smoking crowd, but maybe Obama will help bring real change and quit wasting money on herb prosecutions..........![]() I can dream can't I........ ....Some Where In Ded Land..................

| From what I've seen of the conditions regarding associations they're normally used for juveniles - the only times I've seen it with adults is as a specifically added condition in unique cases. Confirm it with a lawyer, but I really doubt you have anything to worry about as far as being ordered to stay away from your girlfriend.

| Actually, in the state of SD, the two contracts are almost interchangeable. The same conditions generally apply to both probation and parole, including the "non-associatrion" clause. If anything, it would be HARDER to enforce on juviniles, because oftentimes, they are required to attend school, along with their fellow probationers. Of course, no one is goingto make them switch schools to meet the conditions of their probation, making it basically irrelavent 8 hours a day. I know Rich isn't looking at parole...just saying that my experience with the parole department never allowed me to see how such a situation would be handled. For whats its worth, theres no gurantee of probation with a charge of possession or distribution of heroin, even in California (which are the potential charges his gf is facing) |

| Here (Mass.) the two are very different. Someone on parole has significantly stricter conditions than someone on probation 90% of the time. I've seen some cases where judges will impose stricter conditions on a probationer given the nature of the crime, past incidents, etc., but in the vast majority of cases there is nothing stopping them from associating with others on probation. Must be a state-by-state thing - I know for example in some states probation officers have full arrest powers, but here in Mass. they seem to be just barely distinguishable from social workers. |
