Ok, well, I finally got caught.
I was over at my friends house, Mark, and we were standing around smoking a cigg. Our other friend had told us earlier to come throw stuff at his window to see if he could come out and chill, but when we did, he said he woud be out in 15 minutes. Well, unbeknownst to us, his next door neighbors had called the cops on us for throwing rocks.
Mark and I were standing by my car in front of his house, and we saw a car pull up real fast around the corner. Mark was like, " I think it's the 5-0", and i was like, so, we're not doing anything. The cop pulls up, jumps out of his car, and yells at us to put our hands on the car and not to move. So we did what he said.
He then told us that he got a report of people throwing rocks at a window, and that we matched the description. He asked us if he could search the car, and I said no, but he searched it anyway.
He found a gravity bong that I had put in there earlier, and he got all excited, he was yelling, where's the dope, where's the dope, where'd you put it? I politley told him that we had no marijuana, we were just smoking ciggarettes waiting for a friend.
He said that he didn't believe me (we really didn't have any, we weren't planning on smoking), then he proceeds to move my car forward to look for "dope" under the car.
Well, surprise, surprise, he didn't find any. Then he pulls out an empty box of condoms from my car, and tries to tell me that he's sure that Mark and I were sleeping together. Now, Mark is only 16, and I'm about to be 19. And I have a boyfriend, who is 23. I tell him this, and he's like, "Be quiet, Don't talk or move."
Then he pulls out my radio from under my seat that was in the process of being put in my car, and he's just so sure that I stole it, he's insisting that it's not mine. I just didn't say anything.
Anyway, he ends up charging me with posession of paraphernalia and contributing to the delinquency of a minor. He handcuffs me, very tightly. I told him that I couldn't feel my hands, and could he please loosen them a bit.
He said no, that I would run. Now, I'm a girl, wearing flip flops, and he's this big muscle guy. How far am I gonna get? So, today, I have some bad bruising on my wrists, and I'm getting a friend to take pictures for me. I never had a problem with cops before, but this guy was just a jerk, serously.
I have court in 2 weeks for the contributing charge, I'll let you guys know what happens.

that sounds pretty unfair, me and my friends had a unpleasent experiance with cops before about a year ago, it was downtown in the daytime, first mistake, me and 2 others were smoking a joint down the alley when noone was around and it was almost done when a cop walks around the corner and walks towards us. i threw the roach down a sewage drain we were luckley standing by. he said "what are you doing?", my friend said "nothing just chilling here" and he said "bullsh*t i know you boys were smoking dope" and we said we didnt. he then searches all 3 of us and my friend brandon was still holding 2 joints on him, they took them and then he dropped all of us off at home and told each of are parents, my mom was upset because it was the first time she found out i was smoking, but my dad was just like "serves you right you jackass".

That cop sounds like an asshole who was just anxious to bust u on something..good luck in court tell them about him searching ur car with no cause..good luck

Consult some free legal aid in your area, and file a police complaint within 6 months of the incident. Wait until after the court date to file the complaint, because if the judge rules in your favor, saying that the search was unwarranted & without reason, you can use this to your advantage when writing up the complaint. I would make some detailed notes right now so you don't forget anything that happened.

if i was you i'd totally file a complaint.. unless the cop had probable cause (which he obviously didnt, otherwise he wouldn't have asked), he isn't allowed to search your car unless you give permission. if he goes on a search without permission, atleast the charge on the paraphenalia should be dropped.

Well just say that you had no weed, and no intention of smoking, well, except yer cigs, and all they can REALLY get you on is paraphanalia, which is usually a slap on the wrist, they might throw crap at you cuz the other guy was 16, but that should only b minor. If you REALLY wanna wreak the cop's day and cause a big media blitz, claim it was police brutality the way he treated you or something with the cuffs, that shuold piss'em off and maybe just want to get the thing done and over with fast.

they cant get her on paraphenalia if it was an unwarranted search... they have to have probable cause, and aside from them finding something suspicious on a bodysearch, they had no probable cause. the girl said no, that her car wasnt to be searched. by the cop searching, he violated her rights, and that right there can get the paraphenalia charge dropped

Actually, there is a hint of cause. When cops get complaints (like throwing rocks at windows) they usually are in the clear for searching.

What you should have done is said it wasn't your car!
