Heh, put my foot in my mouth there. Well now I guess Im not going to Ontario any time soon if I can help it, I try to avoid places where I hear stories like this. I kind of assume most people are from the US on the internet, because most people I see usually are.

yep, Ontario just ain’t always safe. They told us that the park was a zero tolerance zone because there's so many people doing all sorts of drinking and drugs there lately. If I fight it, I know I probably won’t win. Maybe the court will go easy and let it fly, I hope. I guess I'll find out. It was kind of a sticky situation, no where to throw anything out and stuff all around the car, no excuse why were sitting there. Kind of brings me back to reality that what I’m doing is illegal and even criminal.

"Sounds like you really got your right violated. The police can't just run to your car and pull you out and search it. I think you should definitley fight this. Hopefully get those corrupt cops thrown on the street and get your charges dismissed. Good luck."

"its true, it does seem your rights were violated"

Ok, I'm not expert on Canadian law.........but this seems sort of simple to me. Read EXACTLY what he said:

"I threw the joint under my seat as the woman opened my door"

She was opening the door at the same time he was tossing it under the seat. She can see in the window before she gets to the door handle, which means there is a good chance she saw it before he had a chance to throw it............That's called plain view and is a perfectly legal reason to open the door and pull them out.

Again, I'm no expert on Canadian law, but in the US, it would fly.

Also, you don't know how long they watched with binoculars before coming up on them.

That sucks dude, lucky you got away with a fine, in hawaii, you would most likely go down to the station and whatnot. Getting your weed stolen is never really a good thing, better luck next time.

this type sh*t really pisses me off. What are they expecting to catch you with, a few pounds of weed in some teens car near a park or whatever? Sure, it may make you think twice about smoking in public, and make you pay a small fee for getting caught doing it, but i really can't empathize (sympathize?) with grown people that go around tattling on people for victimless crimes...crimeless crimes. if you wanna get something done go for the freakin grow ops and drug lords, ever heard of attacking the source?

sigh...why bother...

Interesting that the girl didn't get a citation. During my bust there were three guys, only one was carrying, yet all were given citations. (how do you ladies do it?)

The bust sucks, but on the lighter side, it could have been a lot worse. Well, I don't know how it is in Canada, but something similar happened here and on top of the charges, the driver had his car impounded and got to spend a few hours in jail waiting on some bail info.

So although you had to be humiliated for doing squat, you didn't have to spend time in jail and pay to get your car out of impound. Sorry, but that's it for the good side. Let us know how it turns out.

Sucks, it does, but...

You've heard several posts about smoking in cars or public places. I know when you're young there's just no place else, but that's life. You'd be better off building a tree house, for the love of.....

On the brighter side, since you're not in one of the more draconian of the U.S. States, the Canandian sense of personal liberty and value of the human being is going to save your *ss. There are places here where they might have taken the car, put you through a trial and serious probation. In those states, the concept of simply letting you go is out of the question - you will be spending the night in their care.

Other states, like Ohio, are another matter. Depending on the cop, they might even play a game like "what is this, a bag of tea leave? - you got ripped off, didn't you?"

Here's what I do find absolutely fascinating about your experience. These cops go to the rather extreme effort to display hostility, generating the fear of God in you three, pushing every button available to them, releasing every ounce of anger and frustration that put them in that career in the first place, and then ONLY give you a ticket! What d*ckheads! They must have assumed it would "send a message" - because, it would seem, they have little more power than to do that an summon you to a hearing. Look at the result - you end up driving around smoking yet more freshly purchase pot. Sounds like their message really sank in, didn't it? I'm sure they left with a smile, talking to each other about how those kids won't be smoking again anytime soon.

This represents the ugly underside of cops against the momentum toward decriminalization and legalization of marijuana. They didn't just do their job, they enjoyed it a little to damn much. If they had the power, and therefore the responsibility, to arrest you and decided to let it slide, I can respect that. If they had the power and responsiblity to arrest you and did, I could even respect that. This sounds to me like a damn game, and maybe they do have the authority to play it that way, but the results are exactly the opposite of what they intended, so it simply can't be an effective, wise strategy.
